7 | 7 | relating to the creation of the offense of prohibited conduct of a | |

9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 38, Penal Code, is amended by adding | |
11 | 11 | Section 38.124 to read as follows: | |
12 | 12 | Sec. 38.124. PROHIBITED CONDUCT OF BAIL BOND SURETY. (a) A | |
13 | 13 | person who is a surety on a bail bond in a criminal case commits an | |
14 | 14 | offense if the person knowingly prepares, provides, or otherwise | |
15 | 15 | makes available to the defendant in the case a form for a motion to | |
16 | 16 | reduce the amount of the defendant's bond or for a motion to change | |
17 | 17 | the conditions of the defendant's bond. | |
18 | 18 | (b) It is a defense to prosecution under this section that | |
19 | 19 | the actor is currently licensed to practice law in this state, | |
20 | 20 | another state, or a foreign country and in good standing with the | |
21 | 21 | State Bar of Texas and the state bar or licensing authority of any | |
22 | 22 | and all other states and foreign countries where licensed. | |
23 | 23 | (c) An offense under this section is a state jail felony. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2017. |
