55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of the offense of prohibited conduct of a
88 bail bond surety.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 38, Penal Code, is amended by adding
1111 Section 38.124 to read as follows:
1212 Sec. 38.124. PROHIBITED CONDUCT OF BAIL BOND SURETY. (a) A
1313 person who is a surety on a bail bond in a criminal case commits an
1414 offense if the person knowingly prepares, provides, or otherwise
1515 makes available to the defendant in the case a form for a motion to
1616 reduce the amount of the defendant's bond or for a motion to change
1717 the conditions of the defendant's bond.
1818 (b) It is a defense to prosecution under this section that
1919 the actor is currently licensed to practice law in this state,
2020 another state, or a foreign country and in good standing with the
2121 State Bar of Texas and the state bar or licensing authority of any
2222 and all other states and foreign countries where licensed.
2323 (c) An offense under this section is a state jail felony.
2424 SECTION 2. This Act takes effect September 1, 2017.
