99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to county regulation of roadside vendors and solicitors.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 285.001(a), Transportation Code, is
1414 amended to read as follows:
1515 (a) To promote the public safety, the commissioners court of
1616 a county with a population of more than 1.3 million and a county
1717 with a population of more than 550,000 that is adjacent to a county
1818 with a population of four million by order may regulate the
1919 following in the unincorporated area of the county if they occur on
2020 a public highway or road, in the right-of-way of a public highway or
2121 road, or in a parking lot:
2222 (1) the sale of items by a vendor of food or
2323 merchandise, including live animals;
2424 (2) the erection, maintenance, or placement of a
2525 structure by a vendor of food or merchandise, including live
2626 animals; and
2727 (3) the solicitation of money.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
