| 11 | 11 | | relating to county regulation of roadside vendors and solicitors. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 285.001(a), Transportation Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (a) To promote the public safety, the commissioners court of |
|---|
| 16 | 16 | | a county with a population of more than 1.3 million and a county |
|---|
| 17 | 17 | | with a population of more than 550,000 that is adjacent to a county |
|---|
| 18 | 18 | | with a population of four million by order may regulate the |
|---|
| 19 | 19 | | following in the unincorporated area of the county if they occur on |
|---|
| 20 | 20 | | a public highway or road, in the right-of-way of a public highway or |
|---|
| 21 | 21 | | road, or in a parking lot: |
|---|
| 22 | 22 | | (1) the sale of items by a vendor of food or |
|---|
| 23 | 23 | | merchandise, including live animals; |
|---|
| 24 | 24 | | (2) the erection, maintenance, or placement of a |
|---|
| 25 | 25 | | structure by a vendor of food or merchandise, including live |
|---|
| 26 | 26 | | animals; and |
|---|
| 27 | 27 | | (3) the solicitation of money. |

| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2017. |
