55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the punishment for assault committed against
88 certain sports participants.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.01(c), Penal Code, is amended to read
1111 as follows:
1212 (c) An offense under Subsection (a)(2) or (3) is a Class C
1313 misdemeanor, except that the offense is:
1414 (1) a Class A misdemeanor if the offense is committed
1515 under Subsection (a)(3) against an elderly individual or disabled
1616 individual, as those terms are defined by Section 22.04; or
1717 (2) a Class B misdemeanor if the offense is committed
1818 by any [a] person, other than [who is not] a sports participant who
1919 is an athlete younger than 19 years of age, against another [a]
2020 person the actor knows is a sports participant either:
2121 (A) while the participant is performing duties or
2222 responsibilities in the participant's capacity as a sports
2323 participant; or
2424 (B) in retaliation for or on account of the
2525 participant's performance of a duty or responsibility within the
2626 participant's capacity as a sports participant.
2727 SECTION 2. The change in law made by this Act applies only
2828 to an offense committed on or after the effective date of this Act.
2929 An offense committed before the effective date of this Act is
3030 governed by the law in effect on the date the offense was committed,
3131 and the former law is continued in effect for that purpose. For
3232 purposes of this section, an offense was committed before the
3333 effective date of this Act if any element of the offense occurred
3434 before that date.
3535 SECTION 3. This Act takes effect September 1, 2017.
