9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article 37.05, Code of Criminal Procedure, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Art. 37.05. POLLING THE JURY. (a) The State and [or] the | |
13 | 13 | defendant each [shall] have the right to have the jury polled, which | |
14 | 14 | is done by calling separately the name or identification number of | |
15 | 15 | each juror and asking the juror [him] if the verdict is the juror's | |
16 | 16 | [his]. If all jurors, when asked, answer in the affirmative, the | |
17 | 17 | verdict shall be entered upon the minutes; but if any juror answers | |
18 | 18 | [answer] in the negative, the jury shall retire again to consider | |
19 | 19 | its verdict. | |
20 | 20 | (b) For the purposes of polling the jury in Subsection (a), | |
21 | 21 | the judge may assign each juror an identification number to use in | |
22 | 22 | place of the juror's name. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2017. |
