99 relating to a referendum requirement before the name of a school
1010 district or district campus located in certain counties may be
1111 changed by the district board of trustees.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Section 11.160, Education Code,
1414 is amended to read as follows:
1515 Sec. 11.160. AUTHORITY TO CHANGE NAME OF SCHOOL DISTRICT
1616 GENERALLY [NAME].
1717 SECTION 2. Section 11.160(a), Education Code, is amended to
1818 read as follows:
1919 (a) The board of trustees of an independent school district,
2020 other than a school district subject to Section 11.1601, by
2121 resolution may change the name of the school district.
2222 SECTION 3. Subchapter D, Chapter 11, Education Code, is
2323 amended by adding Section 11.1601 to read as follows:
2424 Sec. 11.1601. AUTHORITY TO CHANGE NAME OF SCHOOL DISTRICT
2525 OR DISTRICT CAMPUS LOCATED IN CERTAIN POPULOUS COUNTIES. (a) The
2626 board of trustees of an independent school district in a county with
2727 a population of 3.3 million or more and with a student enrollment of
2828 more than 200,000 may not change the name of a school district or a
2929 district campus before the district conducts a referendum election
3030 on the issue of whether the name of the district should be changed
3131 or on the issue of whether the name of a district campus should be
3232 changed and:
3333 (1) if the referendum is on the issue of changing the
3434 district's name, a majority of the voters voting in the election
3535 approve the change in name of the district; or
3636 (2) if the referendum is on the issue of changing the
3737 name of a district campus, a majority of the voters voting in the
3838 election approve the change in name of the district campus.
3939 (b) A referendum described by Subsection (a) may be placed
4040 on the ballot at any type of district election, including an
4141 election of district trustees, a bond election, or a special
4242 election.
4343 (c) If a majority of the voters approve the change in name of
4444 the district, the board by resolution may change the name of the
4545 district.
4646 (d) If a majority of the voters approve the change in name of
4747 a district campus, the board by resolution may change the name of
4848 the district campus.
4949 (e) The board shall give notice of the change in name of the
5050 district or a district campus by sending to the commissioner a copy
5151 of the resolution under Subsection (c) or (d), as applicable,
5252 attested by the president and secretary of the board, and a copy of
5353 the election results.
5454 (f) The district or the district campus, under the changed
5555 name, is considered a continuation of the district or district
5656 campus, as the district or district campus was formerly named, for
5757 all purposes.
5858 SECTION 4. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2017.
