66 AN ACT
77 relating to the cremation of human remains by alkaline hydrolysis.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 711.001(7) and (8), Health and Safety
1010 Code, are amended to read as follows:
1111 (7) "Cremation" means the irreversible process of
1212 reducing human remains to essential elements, including bone
1313 fragments, through extreme heat and evaporation or through alkaline
1414 hydrolysis. The process[, which] may include the processing or the
1515 pulverization of bone fragments.
1616 (8) "Crematory" means a structure containing a furnace
1717 or alkaline hydrolysis vessel used or intended to be used for the
1818 cremation of human remains. The term includes a facility that
1919 cremates human remains through alkaline hydrolysis.
2020 SECTION 2. Section 716.001(5), Health and Safety Code, is
2121 amended to read as follows:
2222 (5) "Cremation" means the irreversible process of
2323 reducing human remains to essential elements, including bone
2424 fragments, through direct flame, extreme heat, and evaporation or
2525 through alkaline hydrolysis. The term may include pulverization,
2626 which is the process of reducing identifiable bone fragments after
2727 cremation and processing granulated particles by manual or
2828 mechanical means.
2929 SECTION 3. Section 716.002, Health and Safety Code, is
3030 amended to read as follows:
3131 Sec. 716.002. CREMATION RULES. (a) The commission may
3232 adopt rules consistent with this chapter and Chapter 651,
3333 Occupations Code, to govern the cremation of human remains.
3434 (b) Notwithstanding this chapter and Chapter 651,
3535 Occupations Code, the commission may modify cremation procedures
3636 and requirements under Subchapter D to the extent necessary to
3737 allow cremation through alkaline hydrolysis.
3838 SECTION 4. Section 651.001(3), Occupations Code, is amended
3939 to read as follows:
4040 (3) "Crematory" means a structure containing a furnace
4141 or alkaline hydrolysis vessel used or intended to be used for the
4242 cremation of human remains. The term includes a facility that
4343 cremates human remains through alkaline hydrolysis.
4444 SECTION 5. Section 651.651(1), Occupations Code, is amended
4545 to read as follows:
4646 (1) "Cremation" means the irreversible process of
4747 reducing human remains to essential elements, including bone
4848 fragments, through direct flame, extreme heat, and evaporation or
4949 through alkaline hydrolysis. The term may include pulverization,
5050 which is the process of reducing identifiable bone fragments after
5151 cremation and processing granulated particles by manual or
5252 mechanical means.
5353 SECTION 6. Not later than December 1, 2017, the Texas
5454 Funeral Service Commission shall adopt rules to implement the
5555 changes in law made by this Act.
5656 SECTION 7. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2017.
