55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to notice given to certain medical providers of a change in
88 placement for a child in foster care.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 264.018, Family Code, is amended by
1111 adding Subsection (d-1) to read as follows:
1212 (d-1) As soon as possible but not later than 24 hours after
1313 the department becomes aware of a change in placement of a child in
1414 the conservatorship of the department, the department shall give
1515 notice of the placement change to:
1616 (1) the managed care organization that contracts with
1717 the commission to provide health care services to the child under
1818 the STAR Health program; and
1919 (2) the primary care physician listed in the child's
2020 health passport.
2121 SECTION 2. Subchapter A, Chapter 533, Government Code, is
2222 amended by adding Section 533.0056 to read as follows:
2323 Sec. 533.0056. STAR HEALTH PROGRAM: NOTIFICATION OF
2424 PLACEMENT CHANGE. A contract between a managed care organization
2525 and the commission for the organization to provide health care
2626 services to recipients under the STAR Health program must require
2727 the organization to ensure continuity of care for a child whose
2828 placement has changed by:
2929 (1) notifying each specialist treating the child of
3030 the placement change; and
3131 (2) coordinating the transition of care from the
3232 child's previous treating primary care physician and treating
3333 specialists to the child's new treating primary care physician and
3434 treating specialists, if any.
3535 SECTION 3. The changes in law made by this Act apply only to
3636 a contract for the provision of health care services under the STAR
3737 Health program between the Health and Human Services Commission and
3838 a managed care organization under Chapter 533, Government Code,
3939 that is entered into or renewed on or after the effective date of
4040 this Act.
4141 SECTION 4. If before implementing Section 533.0056,
4242 Government Code, as added by this Act, the Health and Human Services
4343 Commission determines that a waiver or authorization from a federal
4444 agency is necessary for implementation of that provision, the
4545 health and human services agency affected by the provision shall
4646 request the waiver or authorization and may delay implementing that
4747 provision until the waiver or authorization is granted.
4848 SECTION 5. This Act takes effect September 1, 2017.
