7 | 7 | | relating to notice given to certain medical providers of a change in |
---|
8 | 8 | | placement for a child in foster care. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 264.018, Family Code, is amended by |
---|
11 | 11 | | adding Subsection (d-1) to read as follows: |
---|
12 | 12 | | (d-1) As soon as possible but not later than 24 hours after |
---|
13 | 13 | | the department becomes aware of a change in placement of a child in |
---|
14 | 14 | | the conservatorship of the department, the department shall give |
---|
15 | 15 | | notice of the placement change to: |
---|
16 | 16 | | (1) the managed care organization that contracts with |
---|
17 | 17 | | the commission to provide health care services to the child under |
---|
18 | 18 | | the STAR Health program; and |
---|
19 | 19 | | (2) the primary care physician listed in the child's |
---|
20 | 20 | | health passport. |
---|
21 | 21 | | SECTION 2. Subchapter A, Chapter 533, Government Code, is |
---|
22 | 22 | | amended by adding Section 533.0056 to read as follows: |
---|
23 | 23 | | Sec. 533.0056. STAR HEALTH PROGRAM: NOTIFICATION OF |
---|
24 | 24 | | PLACEMENT CHANGE. A contract between a managed care organization |
---|
25 | 25 | | and the commission for the organization to provide health care |
---|
26 | 26 | | services to recipients under the STAR Health program must require |
---|
27 | 27 | | the organization to ensure continuity of care for a child whose |
---|
28 | 28 | | placement has changed by: |
---|
29 | 29 | | (1) notifying each specialist treating the child of |
---|
30 | 30 | | the placement change; and |
---|
31 | 31 | | (2) coordinating the transition of care from the |
---|
32 | 32 | | child's previous treating primary care physician and treating |
---|
33 | 33 | | specialists to the child's new treating primary care physician and |
---|
34 | 34 | | treating specialists, if any. |
---|
35 | 35 | | SECTION 3. The changes in law made by this Act apply only to |
---|
36 | 36 | | a contract for the provision of health care services under the STAR |
---|
37 | 37 | | Health program between the Health and Human Services Commission and |
---|
38 | 38 | | a managed care organization under Chapter 533, Government Code, |
---|
39 | 39 | | that is entered into or renewed on or after the effective date of |
---|
40 | 40 | | this Act. |
---|
41 | 41 | | SECTION 4. If before implementing Section 533.0056, |
---|
42 | 42 | | Government Code, as added by this Act, the Health and Human Services |
---|
43 | 43 | | Commission determines that a waiver or authorization from a federal |
---|
44 | 44 | | agency is necessary for implementation of that provision, the |
---|
45 | 45 | | health and human services agency affected by the provision shall |
---|
46 | 46 | | request the waiver or authorization and may delay implementing that |
---|
47 | 47 | | provision until the waiver or authorization is granted. |
---|
48 | 48 | | SECTION 5. This Act takes effect September 1, 2017. |
