104 AN ACT
115 relating to liability of certain electric utilities that allow
126 certain uses of land that the electric utility owns, occupies, or
137 leases.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 75.0022(b), Civil Practice and Remedies
1610 Code, is amended to read as follows:
1711 (b) This section applies only to an electric utility located
1812 in:
1913 (1) a county with a population of four million or more;
2014 or
2115 (2) a county with a population of 550,000 or more that
2216 is adjacent to a county described by Subdivision (1).
2317 SECTION 2. The change in law made by this Act applies only
2418 to a cause of action that accrues on or after the effective date of
2519 this Act. A cause of action that accrues before the effective date
2620 of this Act is governed by the law in effect immediately before that
2721 date, and that law is continued in effect for that purpose.
2822 SECTION 3. This Act takes effect immediately if it receives
2923 a vote of two-thirds of all the members elected to each house, as
3024 provided by Section 39, Article III, Texas Constitution. If this
3125 Act does not receive the vote necessary for immediate effect, this
3226 Act takes effect September 1, 2017.
