| 6 | 6 | | relating to a requirement that a student's postsecondary transcript |

| 7 | 7 | | include the average or median grade awarded in each class. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 51.979 to read as follows: |
|---|
| 11 | 11 | | Sec. 51.979. TRANSPARENCY IN STUDENT TRANSCRIPTS. (a) In |
|---|
| 12 | 12 | | this section, "general academic teaching institution" has the |
|---|
| 13 | 13 | | meaning assigned by Section 61.003. |
|---|
| 14 | 14 | | (b) Each general academic teaching institution shall |
|---|
| 15 | 15 | | include on a student's transcript, for each class attempted by the |
|---|
| 16 | 16 | | student, the average grade that was awarded to all students in the |
|---|
| 17 | 17 | | class. For a class for which letter grades are awarded, the |
|---|
| 18 | 18 | | institution shall include on the transcript the median grade that |
|---|
| 19 | 19 | | was awarded to all students in the class. |
|---|
| 20 | 20 | | The institution shall |
|---|
| 21 | 21 | | place the average or median grade, as applicable, immediately to |
|---|
| 22 | 22 | | the right of the student's individual grade. |
|---|
| 23 | 23 | | (c) Subsection (b) does not apply to a class: |
|---|
| 24 | 24 | | (1) offered to students solely on a pass-fail basis or |
|---|
| 25 | 25 | | for independent study credit; or |
|---|
| 26 | 26 | | (2) in which grades are reported for 10 students or |
|---|
| 27 | 27 | | fewer. |
|---|
| 28 | 28 | | (d) The Texas Higher Education Coordinating Board shall |
|---|
| 29 | 29 | | adopt rules to administer this section. |
|---|
| 30 | 30 | | SECTION 2. The Texas Higher Education Coordinating Board |
|---|
| 31 | 31 | | shall adopt the rules required by Section 51.979, Education Code, |
|---|
| 32 | 32 | | as added by this Act, as soon as practicable after this Act takes |
|---|
| 33 | 33 | | effect. For that purpose, the coordinating board may adopt the |
|---|
| 34 | 34 | | initial rules in the manner provided by law for emergency rules. |
|---|
| 35 | 35 | | SECTION 3. The change in law made by this Act applies |
|---|
| 36 | 36 | | beginning with the 2017 fall semester. |
|---|
| 37 | 37 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2017. |
