| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.0812, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a) Except as provided by Subsection (a-1) or (b), a school |
|---|
| 14 | 14 | | district may not schedule the last day of school for students for a |
|---|
| 15 | 15 | | school year before May 15 or after the Friday preceding Memorial |
|---|
| 16 | 16 | | Day. |
|---|
| 17 | 17 | | (a-1) A school district may schedule the last day of school |
|---|
| 18 | 18 | | for students for a school year after the Friday preceding Memorial |
|---|
| 19 | 19 | | Day if the district operates a year-round system under Section |
|---|
| 20 | 20 | | 25.084. |
|---|
| 21 | 21 | | SECTION 2. Section 25.084(a), Education Code, is amended to |
|---|
| 22 | 22 | | read as follows: |
|---|
| 23 | 23 | | (a) A school district may operate its schools year-round on |
|---|
| 24 | 24 | | either a single-track or a multitrack calendar. If a school |
|---|
| 25 | 25 | | district adopts a year-round system, the district may modify: |
|---|
| 26 | 26 | | (1) the number of contract days of employees and the |
|---|
| 27 | 27 | | number of days of operation, including any time required for staff |
|---|
| 28 | 28 | | development, planning and preparation, and continuing education, |
|---|
| 29 | 29 | | otherwise required by law; |
|---|
| 30 | 30 | | (2) testing dates, data reporting, and related |
|---|
| 31 | 31 | | matters; |
|---|
| 32 | 32 | | (3) the date of the first day of instruction of the |
|---|
| 33 | 33 | | school year under Section 25.0811 and the date of the last day of |
|---|
| 34 | 34 | | school for a school year under Section 25.0812 for a school that was |
|---|
| 35 | 35 | | operating year-round for the 2016-2017 [2000-2001] school year; and |
|---|
| 36 | 36 | | (4) a student's eligibility to participate in |
|---|
| 37 | 37 | | extracurricular activities when the student's calendar track is not |
|---|
| 38 | 38 | | in session. |
|---|
| 39 | 39 | | SECTION 3. This Act applies beginning with the 2018-2019 |
|---|
| 40 | 40 | | school year. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect May 1, 2018. |
