| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 251, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 251.063 to read as follows: |
|---|
| 12 | 12 | | Sec. 251.063. APPLICABILITY OF SUNSET ACT. (a) The |
|---|
| 13 | 13 | | corporation is subject to review under Chapter 325, Government Code |
|---|
| 14 | 14 | | (Texas Sunset Act), but may not be abolished under that chapter. |
|---|
| 15 | 15 | | The review shall be conducted as if the corporation were a state |
|---|
| 16 | 16 | | agency scheduled to be abolished September 1, 2019. |
|---|
| 17 | 17 | | (b) The corporation shall pay the cost incurred by the |
|---|
| 18 | 18 | | Sunset Advisory Commission in performing the review. The Sunset |
|---|
| 19 | 19 | | Advisory Commission shall determine the cost, and the corporation |
|---|
| 20 | 20 | | shall pay the amount promptly on receipt of a statement from the |
|---|
| 21 | 21 | | Sunset Advisory Commission detailing the cost. |
|---|
| 22 | 22 | | (c) The limited review under this section must assess the |
|---|
| 23 | 23 | | corporation's: |
|---|
| 24 | 24 | | (1) governance; |
|---|
| 25 | 25 | | (2) management; |
|---|
| 26 | 26 | | (3) operating structure; and |
|---|
| 27 | 27 | | (4) compliance with legislative requirements. |
|---|
| 28 | 28 | | (d) The corporation reviewed by the Sunset Advisory |
|---|
| 29 | 29 | | Commission under this section may not be required to conduct a |
|---|
| 30 | 30 | | management audit under 30 T.A.C. Chapter 292. |
|---|
| 31 | 31 | | (e) This section expires September 1, 2019. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2017. |
