66 AN ACT
77 relating to the governance of certain housing authorities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 392.031(b), Local Government Code, is
1010 amended to read as follows:
1111 (b) A commissioner may not be an officer or employee of the
1212 municipality. A commissioner may be:
1313 (1) a tenant of a public project over which the housing
1414 authority has jurisdiction; or
1515 (2) a [person who is a] recipient of housing
1616 assistance administered through the authority's housing choice
1717 voucher program or project-based rental assistance program.
1818 SECTION 2. Section 392.0331, Local Government Code, is
1919 amended by amending Subsections (b), (b-2), (g), and (h-1) and
2020 adding Subsection (b-3) to read as follows:
2121 (b) Except as provided by Subsections [Subsection] (b-1)
2222 and (b-2), in appointing commissioners under Section 392.031, a
2323 municipality with a municipal housing authority composed of five
2424 commissioners shall appoint at least one commissioner to the
2525 authority who is a tenant of a public housing project over which the
2626 authority has jurisdiction. Except as provided by Subsection
2727 (b-3) [(b-2)], in appointing commissioners under Section 392.031, a
2828 municipality with a municipal housing authority composed of seven
2929 or more commissioners shall appoint at least two commissioners to
3030 the authority who are tenants of a public housing project over which
3131 the authority has jurisdiction.
3232 (b-2) This subsection applies only to a municipality that
3333 has a population over 600,000 and is located adjacent to the
3434 international border of this state. In appointing commissioners
3535 under Section 392.031, a municipality described by this subsection
3636 that has a municipal housing authority composed of five
3737 commissioners shall appoint at least one commissioner to the
3838 authority who is:
3939 (1) a tenant of a public housing project over which the
4040 authority has jurisdiction; or
4141 (2) a recipient of housing assistance administered
4242 through the authority's housing choice voucher program or
4343 project-based rental assistance program.
4444 (b-3) In appointing commissioners under Section 392.031, a
4545 municipality that has a population over two million and a municipal
4646 housing authority composed of seven or more commissioners shall
4747 appoint at least two commissioners to the authority who are:
4848 (1) tenants of a public housing project over which the
4949 authority has jurisdiction; or
5050 (2) recipients of housing assistance administered
5151 through the authority's housing choice voucher program.
5252 (g) A commissioner appointed under this section may not
5353 participate:
5454 (1) in any vote or discussion concerning the
5555 termination of:
5656 (A) the commissioner's occupancy rights in
5757 public housing;
5858 (B) the commissioner's rights to housing
5959 assistance administered through a housing choice voucher program or
6060 a project-based rental assistance program; or
6161 (C) the rights of any person related in the first
6262 degree by consanguinity to the commissioner with respect to the
6363 person's occupancy rights in public housing or right to receive
6464 housing assistance administered through a housing choice voucher
6565 program or a project-based rental assistance program; or
6666 (2) in a grievance or administrative hearing in which
6767 the commissioner or a person related in the first degree by
6868 consanguinity to the commissioner is a party.
6969 (h-1) If a commissioner appointed under this section as a
7070 recipient of housing assistance administered through the
7171 authority's housing choice voucher program or project-based rental
7272 assistance program ceases to receive that assistance, a majority of
7373 the other commissioners shall decide whether to request that a new
7474 commissioner be appointed. A majority of the commissioners may
7575 decide to allow the commissioner to serve the remaining portion of
7676 the commissioner's term.
7777 SECTION 3. This Act takes effect September 1, 2017.
