| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. The heading to Chapter 1552, Insurance Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | CHAPTER 1552. [GROUP] LONG-TERM CARE INSURANCE FOR STATE EMPLOYEES |
|---|
| 12 | 12 | | SECTION 2. Section 1552.002, Insurance Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | Sec. 1552.002. ESTABLISHMENT OF PROGRAM. (a) The board of |
|---|
| 15 | 15 | | trustees may establish a [group] long-term care insurance program |
|---|
| 16 | 16 | | to provide long-term care insurance coverage for: |
|---|
| 17 | 17 | | (1) an individual eligible to participate in the |
|---|
| 18 | 18 | | program provided by Chapter 1551 as an employee or annuitant; |
|---|
| 19 | 19 | | (2) the spouse, parent, or grandparent of an employee |
|---|
| 20 | 20 | | or annuitant; and |
|---|
| 21 | 21 | | (3) a parent of a spouse described by Subdivision (2). |
|---|
| 22 | 22 | | (b) The board of trustees may not implement a [group] |
|---|
| 23 | 23 | | long-term care insurance program unless any cost or administrative |
|---|
| 24 | 24 | | burden associated with the development of, implementation of, or |
|---|
| 25 | 25 | | communications about the program is incidental. |
|---|
| 26 | 26 | | SECTION 3. Section 1552.003, Insurance Code, is amended to |
|---|
| 27 | 27 | | read as follows: |
|---|
| 28 | 28 | | Sec. 1552.003. ADMINISTERING FIRM. The board of trustees |
|---|
| 29 | 29 | | may select an administering firm to administer the [group] |
|---|
| 30 | 30 | | long-term care insurance program under contract with the board. |
|---|
| 31 | 31 | | SECTION 4. Section 1552.005(a), Insurance Code, is amended |
|---|
| 32 | 32 | | to read as follows: |
|---|
| 33 | 33 | | (a) The [group] long-term care insurance program is not part |
|---|
| 34 | 34 | | of the group coverages offered under Chapter 1551. |
|---|
| 35 | 35 | | SECTION 5. Section 1552.006, Insurance Code, is amended to |
|---|
| 36 | 36 | | read as follows: |
|---|
| 37 | 37 | | Sec. 1552.006. RULES. The board of trustees may adopt rules |
|---|
| 38 | 38 | | as necessary to implement this chapter, including rules specifying |
|---|
| 39 | 39 | | the coverage to be offered under the [group] long-term care |
|---|
| 40 | 40 | | insurance program. |
|---|
| 41 | 41 | | SECTION 6. Section 1552.004, Insurance Code, is repealed. |
|---|
| 42 | 42 | | SECTION 7. The Employees Retirement System of Texas shall |
|---|
| 43 | 43 | | ensure that all group long-term care insurance coverage in effect |
|---|
| 44 | 44 | | immediately before the effective date of this Act under Chapter |
|---|
| 45 | 45 | | 1552, Insurance Code, continues to be administered in accordance |
|---|
| 46 | 46 | | with Chapter 1552, Insurance Code, as it existed immediately before |
|---|
| 47 | 47 | | the effective date of this Act. |
|---|
| 48 | 48 | | SECTION 8. This Act takes effect September 1, 2017. |
