77 relating to long-term care insurance for state employees.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Chapter 1552, Insurance Code, is
1010 amended to read as follows:
1111 CHAPTER 1552. [GROUP] LONG-TERM CARE INSURANCE FOR STATE EMPLOYEES
1212 SECTION 2. Section 1552.002, Insurance Code, is amended to
1313 read as follows:
1414 Sec. 1552.002. ESTABLISHMENT OF PROGRAM. (a) The board of
1515 trustees may establish a [group] long-term care insurance program
1616 to provide long-term care insurance coverage for:
1717 (1) an individual eligible to participate in the
1818 program provided by Chapter 1551 as an employee or annuitant;
1919 (2) the spouse, parent, or grandparent of an employee
2020 or annuitant; and
2121 (3) a parent of a spouse described by Subdivision (2).
2222 (b) The board of trustees may not implement a [group]
2323 long-term care insurance program unless any cost or administrative
2424 burden associated with the development of, implementation of, or
2525 communications about the program is incidental.
2626 SECTION 3. Section 1552.003, Insurance Code, is amended to
2727 read as follows:
2828 Sec. 1552.003. ADMINISTERING FIRM. The board of trustees
2929 may select an administering firm to administer the [group]
3030 long-term care insurance program under contract with the board.
3131 SECTION 4. Section 1552.005(a), Insurance Code, is amended
3232 to read as follows:
3333 (a) The [group] long-term care insurance program is not part
3434 of the group coverages offered under Chapter 1551.
3535 SECTION 5. Section 1552.006, Insurance Code, is amended to
3636 read as follows:
3737 Sec. 1552.006. RULES. The board of trustees may adopt rules
3838 as necessary to implement this chapter, including rules specifying
3939 the coverage to be offered under the [group] long-term care
4040 insurance program.
4141 SECTION 6. Section 1552.004, Insurance Code, is repealed.
4242 SECTION 7. The Employees Retirement System of Texas shall
4343 ensure that all group long-term care insurance coverage in effect
4444 immediately before the effective date of this Act under Chapter
4545 1552, Insurance Code, continues to be administered in accordance
4646 with Chapter 1552, Insurance Code, as it existed immediately before
4747 the effective date of this Act.
4848 SECTION 8. This Act takes effect September 1, 2017.
