| 8 | 8 | | trustees of certain independent school districts; creating a |

| 9 | 9 | | criminal offense. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 11.064, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (a-5) and amending Subsection (c) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (a-5) A member of the board of trustees of an independent |
|---|
| 15 | 15 | | school district with a student enrollment of more than 30,000 is |
|---|
| 16 | 16 | | required to file the financial statement required of state officers |
|---|
| 17 | 17 | | under Subchapter B, Chapter 572, Government Code, in the same |
|---|
| 18 | 18 | | manner as the members of a board of trustees that has adopted a |
|---|
| 19 | 19 | | resolution under Subsection (a). |
|---|
| 20 | 20 | | (c) A trustee required to file the financial statement under |
|---|
| 21 | 21 | | this section [serving in a school district that has adopted a |
|---|
| 22 | 22 | | resolution under Subsection (a) or that is subject to an order |
|---|
| 23 | 23 | | issued under Subsection (a-3)] commits an offense if the trustee |
|---|
| 24 | 24 | | fails to file the statement [required by the resolution or order]. |
|---|
| 25 | 25 | | An offense under this section is a Class B misdemeanor. |
|---|
| 26 | 26 | | SECTION 2. Section 11.064(a-5), Education Code, as added by |
|---|
| 27 | 27 | | this Act, applies beginning January 1, 2019, to a trustee who, |
|---|
| 28 | 28 | | before the effective date of this Act, was not required to file a |
|---|
| 29 | 29 | | financial statement under Section 11.064 or 11.0641, Education |
|---|
| 30 | 30 | | Code, and such a trustee is not required to include financial |
|---|
| 31 | 31 | | activity occurring before January 1, 2018, in a statement filed |
|---|
| 32 | 32 | | under Section 11.064, Education Code. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect January 1, 2018. |
