55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the filing of financial disclosure statements by
88 trustees of certain independent school districts; creating a
99 criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 11.064, Education Code, is amended by
1212 adding Subsection (a-5) and amending Subsection (c) to read as
1313 follows:
1414 (a-5) A member of the board of trustees of an independent
1515 school district with a student enrollment of more than 30,000 is
1616 required to file the financial statement required of state officers
1717 under Subchapter B, Chapter 572, Government Code, in the same
1818 manner as the members of a board of trustees that has adopted a
1919 resolution under Subsection (a).
2020 (c) A trustee required to file the financial statement under
2121 this section [serving in a school district that has adopted a
2222 resolution under Subsection (a) or that is subject to an order
2323 issued under Subsection (a-3)] commits an offense if the trustee
2424 fails to file the statement [required by the resolution or order].
2525 An offense under this section is a Class B misdemeanor.
2626 SECTION 2. Section 11.064(a-5), Education Code, as added by
2727 this Act, applies beginning January 1, 2019, to a trustee who,
2828 before the effective date of this Act, was not required to file a
2929 financial statement under Section 11.064 or 11.0641, Education
3030 Code, and such a trustee is not required to include financial
3131 activity occurring before January 1, 2018, in a statement filed
3232 under Section 11.064, Education Code.
3333 SECTION 3. This Act takes effect January 1, 2018.
