66 AN ACT
77 relating to a requirement that certain state agencies report on
88 border security operations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 322, Government Code, is amended by
1111 adding Section 322.025 to read as follows:
1212 Sec. 322.025. REPORT ON BORDER SECURITY OPERATIONS. (a) In
1313 this section:
1414 (1) "Border security" means the activities in a
1515 reportable county associated with deterring crimes and enforcing
1616 state laws related to:
1717 (A) an offense under Chapters 19, 20, 20A, 22,
1818 34, 36, 46, and 71, Penal Code, that is punishable as a felony of the
1919 third degree or higher;
2020 (B) an offense under Chapter 481, Health and
2121 Safety Code, that is punishable as a felony of the third degree or
2222 higher;
2323 (C) an offense under Section 31.03, Penal Code,
2424 in which the actor obtained another person's property by using
2525 actual or threatened force, violence, or fear or under the color of
2626 official right;
2727 (D) any offense that is coordinated with or
2828 related to activities or crimes that occur or are committed in the
2929 United Mexican States; or
3030 (E) any offense for which the state receives
3131 federal money to enhance law enforcement efforts relating to the
3232 offense.
3333 (2) "Reportable county" means a county:
3434 (A) adjacent to or a portion of which is located
3535 within 20 miles of an international border;
3636 (B) adjacent to two counties located on an
3737 international border with a population of more than 5,000 and less
3838 than 7,500 according to the most recent decennial census;
3939 (C) adjacent to the Gulf Intracoastal Waterway,
4040 as defined by Section 51.002, Transportation Code; or
4141 (D) with a population of more than 1 million.
4242 (b) The Department of Public Safety, Texas Military
4343 Department, Parks and Wildlife Department, trusteed programs
4444 within the office of the governor, Texas Department of Criminal
4545 Justice, and any other state agency designated by the board shall
4646 report to the board twice each state fiscal year of the fiscal
4747 biennium ending August 31, 2019, the following:
4848 (1) the amount of money the agency budgeted for border
4949 security and the amount of money the agency spent on border security
5050 during the reporting period in each reportable county and
5151 statewide;
5252 (2) the method of finance for budgeted and expended
5353 amounts;
5454 (3) the object of expense for budgeted and expended
5555 amounts;
5656 (4) the amount of money the agency spent on employee
5757 salaries during the reporting period for duties related to border
5858 security, including regular and overtime pay, in each reportable
5959 county and statewide;
6060 (5) the agency's performance related to border
6161 security during the reporting period in each reportable county and
6262 statewide including:
6363 (A) the arrest rates measuring the number of
6464 arrests by the agency in the state fiscal year compared to an
6565 average of the number of arrests in the immediately preceding five
6666 state fiscal years for human trafficking, illicit drug
6767 transportation or smuggling, stolen vehicles used in illicit drug
6868 transportation or smuggling, smuggling of persons, and organized
6969 crime;
7070 (B) an illicit drugs seizure rate measuring the
7171 amount and type of illicit drugs seized by the agency in the state
7272 fiscal year compared to an average of the amount and type of illicit
7373 drugs seized by the agency for the immediately preceding five
7474 state fiscal years;
7575 (C) the total number and an itemized list of
7676 illicit drug interdictions in trafficking quantities by the agency;
7777 (D) the total number and an itemized list of
7878 currency seizures connected to organized crime arrests with amounts
7979 of currency by the agency; and
8080 (E) a currency seizure rate measuring the amount
8181 of currency seized by the agency in the state fiscal year compared
8282 to an average of the amount of currency seized by the agency for the
8383 immediately preceding five state fiscal years; and
8484 (6) any other information relating to the agency's
8585 border security operations that the board may require.
8686 (c) A state agency required by Subsection (b) to report
8787 information to the board shall submit information for the first
8888 half of a state fiscal year not later than March 31 of that year and
8989 information for the second half of a state fiscal year not later
9090 than September 30 of that year. The state agency shall submit the
9191 information in the manner prescribed by the board.
9292 (d) This section expires January 1, 2020.
9393 SECTION 2. This Act takes effect September 1, 2017.
