7 | 7 | | relating to a requirement that certain state agencies report on |

8 | 8 | | border security operations. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Chapter 322, Government Code, is amended by |
---|
11 | 11 | | adding Section 322.025 to read as follows: |
---|
12 | 12 | | Sec. 322.025. REPORT ON BORDER SECURITY OPERATIONS. (a) In |
---|
13 | 13 | | this section: |
---|
14 | 14 | | (1) "Border security" means the activities in a |
---|
15 | 15 | | reportable county associated with deterring crimes and enforcing |
---|
16 | 16 | | state laws related to: |
---|
17 | 17 | | (A) an offense under Chapters 19, 20, 20A, 22, |
---|
18 | 18 | | 34, 36, 46, and 71, Penal Code, that is punishable as a felony of the |
---|
19 | 19 | | third degree or higher; |
---|
20 | 20 | | (B) an offense under Chapter 481, Health and |
---|
21 | 21 | | Safety Code, that is punishable as a felony of the third degree or |
---|
22 | 22 | | higher; |
---|
23 | 23 | | (C) an offense under Section 31.03, Penal Code, |
---|
24 | 24 | | in which the actor obtained another person's property by using |
---|
25 | 25 | | actual or threatened force, violence, or fear or under the color of |
---|
26 | 26 | | official right; |
---|
27 | 27 | | (D) any offense that is coordinated with or |
---|
28 | 28 | | related to activities or crimes that occur or are committed in the |
---|
29 | 29 | | United Mexican States; or |
---|
30 | 30 | | (E) any offense for which the state receives |
---|
31 | 31 | | federal money to enhance law enforcement efforts relating to the |
---|
32 | 32 | | offense. |
---|
33 | 33 | | (2) "Reportable county" means a county: |
---|
34 | 34 | | (A) adjacent to or a portion of which is located |
---|
35 | 35 | | within 20 miles of an international border; |
---|
36 | 36 | | (B) adjacent to two counties located on an |
---|
37 | 37 | | international border with a population of more than 5,000 and less |
---|
38 | 38 | | than 7,500 according to the most recent decennial census; |
---|
39 | 39 | | (C) adjacent to the Gulf Intracoastal Waterway, |
---|
40 | 40 | | as defined by Section 51.002, Transportation Code; or |
---|
41 | 41 | | (D) with a population of more than 1 million. |
---|
42 | 42 | | (b) The Department of Public Safety, Texas Military |
---|
43 | 43 | | Department, Parks and Wildlife Department, trusteed programs |
---|
44 | 44 | | within the office of the governor, Texas Department of Criminal |
---|
45 | 45 | | Justice, and any other state agency designated by the board shall |
---|
46 | 46 | | report to the board twice each state fiscal year of the fiscal |
---|
47 | 47 | | biennium ending August 31, 2019, the following: |
---|
48 | 48 | | (1) the amount of money the agency budgeted for border |
---|
49 | 49 | | security and the amount of money the agency spent on border security |
---|
50 | 50 | | during the reporting period in each reportable county and |
---|
51 | 51 | | statewide; |
---|
52 | 52 | | (2) the method of finance for budgeted and expended |
---|
53 | 53 | | amounts; |
---|
54 | 54 | | (3) the object of expense for budgeted and expended |
---|
55 | 55 | | amounts; |
---|
56 | 56 | | (4) the amount of money the agency spent on employee |
---|
57 | 57 | | salaries during the reporting period for duties related to border |
---|
58 | 58 | | security, including regular and overtime pay, in each reportable |
---|
59 | 59 | | county and statewide; |
---|
60 | 60 | | (5) the agency's performance related to border |
---|
61 | 61 | | security during the reporting period in each reportable county and |
---|
62 | 62 | | statewide including: |
---|
63 | 63 | | (A) the arrest rates measuring the number of |
---|
64 | 64 | | arrests by the agency in the state fiscal year compared to an |
---|
65 | 65 | | average of the number of arrests in the immediately preceding five |
---|
66 | 66 | | state fiscal years for human trafficking, illicit drug |
---|
67 | 67 | | transportation or smuggling, stolen vehicles used in illicit drug |
---|
68 | 68 | | transportation or smuggling, smuggling of persons, and organized |
---|
69 | 69 | | crime; |
---|
70 | 70 | | (B) an illicit drugs seizure rate measuring the |
---|
71 | 71 | | amount and type of illicit drugs seized by the agency in the state |
---|
72 | 72 | | fiscal year compared to an average of the amount and type of illicit |
---|
73 | 73 | | drugs seized by the agency for the immediately preceding five |
---|
74 | 74 | | state fiscal years; |
---|
75 | 75 | | (C) the total number and an itemized list of |
---|
76 | 76 | | illicit drug interdictions in trafficking quantities by the agency; |
---|
77 | 77 | | (D) the total number and an itemized list of |
---|
78 | 78 | | currency seizures connected to organized crime arrests with amounts |
---|
79 | 79 | | of currency by the agency; and |
---|
80 | 80 | | (E) a currency seizure rate measuring the amount |
---|
81 | 81 | | of currency seized by the agency in the state fiscal year compared |
---|
82 | 82 | | to an average of the amount of currency seized by the agency for the |
---|
83 | 83 | | immediately preceding five state fiscal years; and |
---|
84 | 84 | | (6) any other information relating to the agency's |
---|
85 | 85 | | border security operations that the board may require. |
---|
86 | 86 | | (c) A state agency required by Subsection (b) to report |
---|
87 | 87 | | information to the board shall submit information for the first |
---|
88 | 88 | | half of a state fiscal year not later than March 31 of that year and |
---|
89 | 89 | | information for the second half of a state fiscal year not later |
---|
90 | 90 | | than September 30 of that year. The state agency shall submit the |
---|
91 | 91 | | information in the manner prescribed by the board. |
---|
92 | 92 | | (d) This section expires January 1, 2020. |
---|
93 | 93 | | SECTION 2. This Act takes effect September 1, 2017. |
