77 relating to probation of certain disqualifications from driving a
88 commercial motor vehicle.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 522.085, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 522.085. PROBATION OF DISQUALIFICATION [PROHIBITED].
1313 (a) Notwithstanding Section 521.303, and except as provided by
1414 Subsection (b), if a person is disqualified under this chapter, the
1515 disqualification may not be probated.
1616 (b) A disqualification under Section 522.081(a) may be
1717 probated under Section 521.309 for a period not to exceed one year
1818 if the disqualified person:
1919 (1) attends and successfully completes a driving
2020 safety course approved by the Texas Department of Licensing and
2121 Regulation; and
2222 (2) does not commit a violation giving rise to a
2323 disqualification under this chapter during the period of probation.
2424 (c) If the department probates a person's disqualification
2525 under this section, the person may continue to operate a commercial
2626 motor vehicle under the person's commercial driver's license during
2727 the period of probation.
2828 SECTION 2. This Act takes effect September 1, 2017.
