| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 256.103(b), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) Grants distributed during a fiscal year must be |
|---|
| 13 | 13 | | allocated among counties as follows: |
|---|
| 14 | 14 | | (1) 20 percent according to weight tolerance permits, |
|---|
| 15 | 15 | | determined by the ratio of weight tolerance permits issued in the |
|---|
| 16 | 16 | | preceding fiscal year for the county that designated a county |
|---|
| 17 | 17 | | energy transportation reinvestment zone to the total number of |
|---|
| 18 | 18 | | weight tolerance permits issued in the state in that fiscal year, as |
|---|
| 19 | 19 | | determined by the Texas Department of Motor Vehicles; |
|---|
| 20 | 20 | | (2) 20 percent according to oil and gas production |
|---|
| 21 | 21 | | taxes, determined by the ratio of oil and gas production taxes |
|---|
| 22 | 22 | | collected by the comptroller in the preceding fiscal year in the |
|---|
| 23 | 23 | | county that designated a county energy transportation reinvestment |
|---|
| 24 | 24 | | zone to the total amount of oil and gas production taxes collected |
|---|
| 25 | 25 | | in the state in that fiscal year, as determined by the comptroller; |
|---|
| 26 | 26 | | (3) 40 [50] percent according to well completions, |
|---|
| 27 | 27 | | determined by the ratio of well completions in the preceding fiscal |
|---|
| 28 | 28 | | year in the county that designated a county energy transportation |
|---|
| 29 | 29 | | reinvestment zone to the total number of well completions in the |
|---|
| 30 | 30 | | state in that fiscal year, as determined by the Railroad Commission |
|---|
| 31 | 31 | | of Texas; [and] |
|---|
| 32 | 32 | | (4) 10 percent according to the volume of oil and gas |
|---|
| 33 | 33 | | waste injected, determined by the ratio of the volume of oil and gas |
|---|
| 34 | 34 | | waste injected in the preceding fiscal year in the county that |
|---|
| 35 | 35 | | designated a county energy transportation reinvestment zone to the |
|---|
| 36 | 36 | | total volume of oil and gas waste injected in the state in that |
|---|
| 37 | 37 | | fiscal year, as determined by the Railroad Commission of Texas; and |
|---|
| 38 | 38 | | (5) 10 percent according to international bridge |
|---|
| 39 | 39 | | crossings, determined by the ratio of international bridge |
|---|
| 40 | 40 | | crossings in the preceding fiscal year in the county to the total |
|---|
| 41 | 41 | | number of international bridge crossings in the state in that |
|---|
| 42 | 42 | | fiscal year. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2017. |
