11	4		AN ACT
12	5		relating to investment training for officers of public housing
13	6		authorities.
14	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	8		SECTION 1. Section 2256.008(a), Government Code, as amended
16	9		by Chapters 222 (H.B. 1148) and 1248 (H.B. 870), Acts of the 84th
17	10		Legislature, Regular Session, 2015, is reenacted and amended to
18	11		read as follows:
19	12		(a) Except as provided by Subsections (a-1), (b), (b-1),
20	13		[and] (e), and (f), the treasurer, the chief financial officer if
21	14		the treasurer is not the chief financial officer, and the
22	15		investment officer of a local government shall:
23	16		(1) attend at least one training session from an
24	17		independent source approved by the governing body of the local
25	18		government or a designated investment committee advising the
26	19		investment officer as provided for in the investment policy of the
27	20		local government and containing at least 10 hours of instruction
28	21		relating to the treasurer's or officer's responsibilities under
29	22		this subchapter within 12 months after taking office or assuming
30	23		duties; and
31	24		(2) [except as provided by Subsections (b), (e), and
32	25		(f),] attend an investment training session not less than once in a
33	26		two-year period that begins on the first day of that local
34	27		government's fiscal year and consists of the two consecutive fiscal
35	28		years after that date, and receive not less than 10 hours of
36	29		instruction relating to investment responsibilities under this
37	30		subchapter from an independent source approved by the governing
38	31		body of the local government or a designated investment committee
39	32		advising the investment officer as provided for in the investment
40	33		policy of the local government.
41	34		SECTION 2. Section 2256.008, Government Code, is amended by
42	35		adding Subsection (b-1) and amending Subsection (f) to read as
43	36		follows:
44	37		(b-1) A housing authority created under Chapter 392, Local
45	38		Government Code, may satisfy the training requirement provided by
46	39		Subsection (a)(2) by requiring the following person to attend, in
47	40		each two-year period that begins on the first day of that housing
48	41		authority's fiscal year and consists of the two consecutive fiscal
49	42		years after that date, at least five hours of appropriate
50	43		instruction:
51	44		(1) the treasurer, or the chief financial officer if
52	45		the treasurer is not the chief financial officer, or the investment
53	46		officer; or
54	47		(2) if the authority does not have an officer
55	48		described by Subdivision (1), another officer of the authority.
56	49		(f) Subsection (a)(2) does not apply to an officer of a
57	50		municipality or housing authority if the municipality or housing
58	51		authority:
59	52		(1) does not invest municipal or housing authority
60	53		funds, as applicable; or
61	54		(2) only deposits those [municipal] funds in:
62	55		(A) interest-bearing deposit accounts; or
63	56		(B) certificates of deposit as authorized by
64	57		Section 2256.010.
65	58		SECTION 3. To the extent of any conflict, this Act prevails
66	59		over another Act of the 85th Legislature, Regular Session, 2017,
67	60		relating to nonsubstantive additions to and corrections in enacted
68	61		codes.
69	62		SECTION 4. This Act takes effect September 1, 2017.
