88 AN ACT
99 relating to student success-based funding recommendations for
1010 certain public institutions of higher education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 61.0593(a), Education Code, is amended
1313 to read as follows:
1414 (a) The legislature finds that it is in the state's highest
1515 public interest to evaluate student achievement at institutions of
1616 higher education and to develop higher education funding policy
1717 based on that evaluation. Funding policies that promote
1818 postsecondary educational success based on objective indicators of
1919 relative performance, such as the number of degrees awarded [degree
2020 completion rates], are critical to maintaining the state's
2121 competitiveness in the national and global economy and supporting
2222 the general welfare of this state. Therefore, the purpose of this
2323 section is to ensure that institutions of higher education produce
2424 student outcomes that are directly aligned with the state's
2525 education goals and economic development needs.
2626 SECTION 2. Section 61.0593(b)(1), Education Code, is
2727 amended to read as follows:
2828 (1) "At-risk student" means an undergraduate student
2929 of an institution of higher education:
3030 (A) who has previously received [been awarded] a
3131 grant under the federal Pell Grant program or met the Expected
3232 Family Contribution (EFC) criterion for a grant under that program;
3333 or
3434 (B) whose [who, on the date the student initially
3535 enrolled in the institution:
3636 [(i) was 20 years of age or older;
3737 [(ii) had a] score on the SAT [Scholastic
3838 Assessment Test (SAT)] or the ACT, excluding the optional essay
3939 test, is [American College Test (ACT) that was] less than the
4040 national mean of students' scores on the applicable [score for
4141 students taking that] test[;
4242 [(iii) was enrolled as a part-time student;
4343 or
4444 [(iv) had not received a high school
4545 diploma but had received a high school equivalency certificate
4646 within the last six years].
4747 SECTION 3. Section 61.0593, Education Code, is amended by
4848 amending Subsection (d) and adding Subsections (d-1), (d-2), and
4949 (d-3) to read as follows:
5050 (d) This subsection applies only to a general academic
5151 teaching institution other than a public state college. In
5252 devising its funding formulas and making its recommendations to the
5353 legislature relating to institutional appropriations of funds
5454 under Section 61.059 for institutions to which this subsection
5555 applies, the board, in the manner and to the extent the board
5656 considers appropriate and in consultation with those institutions,
5757 shall prescribe a formula for allocating funds to the institutions
5858 in proportion to the number of weighted points earned by each of the
5959 institutions according to the following success measures
6060 [incorporate the consideration of undergraduate student success
6161 measures achieved during the preceding state fiscal biennium by
6262 each of the institutions. At the time the board makes those
6363 recommendations, the board shall also make recommendations for
6464 incorporating the success measures, to the extent the board
6565 considers appropriate in consultation with those institutions,
6666 into the distribution of any incentive funds available for those
6767 institutions, including performance incentive funds under
6868 Subchapter D, Chapter 62. The board's recommendations must provide
6969 alternative approaches for applying the success measures and must
7070 compare the effects on funding of applying the success measures
7171 within the formula for base funding to applying the success
7272 measures as a separate formula. The success measures considered by
7373 the board under this subsection may include]:
7474 (1) the total number of bachelor's degrees awarded by
7575 the institution to not at-risk students; and
7676 (2) [the total number of bachelor's degrees in
7777 critical fields awarded by the institution;
7878 [(3)] the total number of bachelor's degrees awarded
7979 by the institution to at-risk students[; and
8080 [(4) as determined by the board, the six-year
8181 graduation rate of undergraduate students of the institution who
8282 initially enrolled in the institution in the fall semester
8383 immediately following their graduation from a public high school in
8484 this state as compared to the six-year graduation rate predicted
8585 for those students based on the composition of the institution's
8686 student body].
8787 (d-1) In the formula prescribed under Subsection (d), the
8888 board shall:
8989 (1) compute points for each success measure using the
9090 average number of degrees awarded for the three most recent
9191 academic years for which the information is available; and
9292 (2) assign the following weights to each degree
9393 awarded by an institution to which that subsection applies:
9494 (A) 1.0, for a not at-risk student; and
9595 (B) 2.0, for an at-risk student.
9696 (d-2) The board's recommendations under Subsection (d) must
9797 provide and compare the alternative approaches of applying the
9898 success measures described by that subsection within the formula
9999 for base funding and applying the success measures described by
100100 that subsection outside the formula for base funding.
101101 (d-3) At the time the board makes its recommendations under
102102 Subsection (d) for institutions to which that subsection applies,
103103 the board shall also make recommendations for incorporating the
104104 success measures described by that subsection, to the extent the
105105 board considers appropriate in consultation with those
106106 institutions, into the distribution of any incentive funds
107107 available for those institutions, including performance incentive
108108 funds under Subchapter D, Chapter 62.
109109 SECTION 4. Sections 61.0593(b)(2), (c), and (e), Education
110110 Code, are repealed.
111111 SECTION 5. The Texas Higher Education Coordinating Board
112112 shall adopt rules for the administration of Section 61.0593,
113113 Education Code, as amended by this Act, not later than May 1, 2018.
114114 SECTION 6. This Act takes effect immediately if it receives
115115 a vote of two-thirds of all the members elected to each house, as
116116 provided by Section 39, Article III, Texas Constitution. If this
117117 Act does not receive the vote necessary for immediate effect, this
118118 Act takes effect September 1, 2017.
