66 AN ACT
77 relating to registration or transfer of title of a motor vehicle
88 alleged to have been involved in a violation detected by a
99 photographic traffic signal enforcement system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 707.017, Transportation Code, is amended
1212 to read as follows:
1313 Sec. 707.017. REGISTRATION OR TRANSFER OF TITLE AFTER
1414 NOTICE OF VIOLATION ISSUED [ENFORCEMENT]. (a) Neither the [If the
1515 owner of a motor vehicle is delinquent in the payment of a civil
1616 penalty imposed under this chapter, the] county assessor-collector
1717 nor [or] the Texas Department of Motor Vehicles may refuse to
1818 transfer the title of or register a motor vehicle alleged to have
1919 been involved in a [the] violation of this chapter solely:
2020 (1) based on the alleged violation; or
2121 (2) because the owner of the motor vehicle is
2222 delinquent in the payment of a civil penalty imposed under this
2323 chapter.
2424 (b) A local authority or the person with which the local
2525 authority contracts for the administration and enforcement of a
2626 photographic traffic signal enforcement system may not provide
2727 information about a violation of this chapter to a person
2828 authorized to register or issue a title for a vehicle under Chapter
2929 501, 502, or 520. [This section does not apply to the registration
3030 of a motor vehicle under Section 501.0234.]
3131 SECTION 2. Section 707.017, Transportation Code, as amended
3232 by this Act, applies only to a civil penalty imposed under Chapter
3333 707, Transportation Code, on or after the effective date of this
3434 Act. A civil penalty imposed before the effective date of this Act
3535 is governed by the law in effect when the civil penalty was imposed,
3636 and the former law is continued in effect for that purpose.
3737 SECTION 3. This Act takes effect September 1, 2017.
