55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the free speech right of a member of a board of trustees
88 of a school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 11, Education Code, is
1111 amended by adding Section 11.066 to read as follows:
1212 Sec. 11.066. FREEDOM OF SPEECH. The commissioner, the
1313 board of trustees of a school district, a member of the board of
1414 trustees of a school district, or any administrator of a school
1515 district may not interfere or restrict the free speech right,
1616 guaranteed by the First Amendment to the United States
1717 Constitution, of a member of the board of trustees of a school
1818 district to publicly express a position regarding or otherwise
1919 discuss any issue under consideration or to be considered by the
2020 board on which the person serves.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2017.
