9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter C, Chapter 11, Education Code, is | |
11 | 11 | amended by adding Section 11.066 to read as follows: | |
12 | 12 | Sec. 11.066. FREEDOM OF SPEECH. The commissioner, the | |
13 | 13 | board of trustees of a school district, a member of the board of | |
14 | 14 | trustees of a school district, or any administrator of a school | |
15 | 15 | district may not interfere or restrict the free speech right, | |
16 | 16 | guaranteed by the First Amendment to the United States | |
17 | 17 | Constitution, of a member of the board of trustees of a school | |
18 | 18 | district to publicly express a position regarding or otherwise | |
19 | 19 | discuss any issue under consideration or to be considered by the | |
20 | 20 | board on which the person serves. | |
21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2017. |
