104 AN ACT
115 relating to the concurrent jurisdiction of certain municipal courts
126 in certain criminal cases punishable by fine only.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Article 4.14(f), Code of Criminal Procedure, is
159 amended to read as follows:
1610 (f) A municipality with a population of 1.19 million or more
1711 and another municipality contiguous to that municipality may enter
1812 into an agreement providing concurrent jurisdiction for the
1913 municipal courts of either jurisdiction for all criminal cases
2014 arising from offenses under state law that are:
2115 (1) committed on the boundary of those municipalities
2216 or in one or both of the following areas:
2317 (A) within 200 yards of that boundary; or
2418 (B) within 2.25 miles of that boundary on a
2519 segment of highway in the state highway system that traverses a
2620 major water supply reservoir; and
2721 (2) punishable by fine only.
2822 SECTION 2. Article 13.045, Code of Criminal Procedure, is
2923 amended to read as follows:
3024 Art. 13.045. ON THE BOUNDARIES OF CERTAIN MUNICIPALITIES.
3125 An offense punishable by fine only that is committed on or near the
3226 boundary[, or within 200 yards of the boundary,] of contiguous
3327 municipalities that have entered into an agreement authorized by
3428 Article 4.14(f) and Section 29.003(h), Government Code, may be
3529 prosecuted in either of those municipalities as provided in the
3630 agreement.
3731 SECTION 3. Section 29.003(h), Government Code, is amended
3832 to read as follows:
3933 (h) A municipality with a population of 1.19 million or more
4034 and another municipality contiguous to that municipality may enter
4135 into an agreement providing concurrent jurisdiction for the
4236 municipal courts of either jurisdiction for all criminal cases
4337 arising from offenses under state law that are:
4438 (1) committed on the boundary of those municipalities
4539 or in one or both of the following areas:
4640 (A) within 200 yards of that boundary; or
4741 (B) within 2.25 miles of that boundary on a
4842 segment of highway in the state highway system that traverses a
4943 major water supply reservoir; and
5044 (2) punishable by fine only.
5145 SECTION 4. This Act takes effect September 1, 2017.
