11 | 5 | | relating to the concurrent jurisdiction of certain municipal courts |

13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
14 | 8 | | SECTION 1. Article 4.14(f), Code of Criminal Procedure, is |
---|
15 | 9 | | amended to read as follows: |
---|
16 | 10 | | (f) A municipality with a population of 1.19 million or more |
---|
17 | 11 | | and another municipality contiguous to that municipality may enter |
---|
18 | 12 | | into an agreement providing concurrent jurisdiction for the |
---|
19 | 13 | | municipal courts of either jurisdiction for all criminal cases |
---|
20 | 14 | | arising from offenses under state law that are: |
---|
21 | 15 | | (1) committed on the boundary of those municipalities |
---|
22 | 16 | | or in one or both of the following areas: |
---|
23 | 17 | | (A) within 200 yards of that boundary; or |
---|
24 | 18 | | (B) within 2.25 miles of that boundary on a |
---|
25 | 19 | | segment of highway in the state highway system that traverses a |
---|
26 | 20 | | major water supply reservoir; and |
---|
27 | 21 | | (2) punishable by fine only. |
---|
28 | 22 | | SECTION 2. Article 13.045, Code of Criminal Procedure, is |
---|
29 | 23 | | amended to read as follows: |
---|
30 | 24 | | Art. 13.045. ON THE BOUNDARIES OF CERTAIN MUNICIPALITIES. |
---|
31 | 25 | | An offense punishable by fine only that is committed on or near the |
---|
32 | 26 | | boundary[, or within 200 yards of the boundary,] of contiguous |
---|
33 | 27 | | municipalities that have entered into an agreement authorized by |
---|
34 | 28 | | Article 4.14(f) and Section 29.003(h), Government Code, may be |
---|
35 | 29 | | prosecuted in either of those municipalities as provided in the |
---|
36 | 30 | | agreement. |

37 | 31 | | SECTION 3. Section 29.003(h), Government Code, is amended |
---|
38 | 32 | | to read as follows: |
---|
