| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 411, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 411.00961 to read as follows: |
|---|
| 13 | 13 | | Sec. 411.00961. MEMORANDUM OF UNDERSTANDING WITH UNITED |
|---|
| 14 | 14 | | STATES DEPARTMENT OF HOMELAND SECURITY; TRAINING. (a) The |
|---|
| 15 | 15 | | department shall require that each peace officer employed by the |
|---|
| 16 | 16 | | department be trained in accordance with a memorandum of |
|---|
| 17 | 17 | | understanding between this state and the United States Department |
|---|
| 18 | 18 | | of Homeland Security concerning the law enforcement officer's role |
|---|
| 19 | 19 | | in enforcing federal immigration laws, in accordance with 8 U.S.C. |
|---|
| 20 | 20 | | Section 1357(g). |
|---|
| 21 | 21 | | (b) The director has authority to negotiate the terms of the |
|---|
| 22 | 22 | | memorandum described by Subsection (a). |
|---|
| 23 | 23 | | (c) A memorandum described by Subsection (a) must be signed |
|---|
| 24 | 24 | | by the director and by the governor. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2017. |
