55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to training of peace officers employed by the Department
88 of Public Safety concerning the enforcement of federal immigration
99 laws.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 411, Government Code, is
1212 amended by adding Section 411.00961 to read as follows:
1313 Sec. 411.00961. MEMORANDUM OF UNDERSTANDING WITH UNITED
1414 STATES DEPARTMENT OF HOMELAND SECURITY; TRAINING. (a) The
1515 department shall require that each peace officer employed by the
1616 department be trained in accordance with a memorandum of
1717 understanding between this state and the United States Department
1818 of Homeland Security concerning the law enforcement officer's role
1919 in enforcing federal immigration laws, in accordance with 8 U.S.C.
2020 Section 1357(g).
2121 (b) The director has authority to negotiate the terms of the
2222 memorandum described by Subsection (a).
2323 (c) A memorandum described by Subsection (a) must be signed
2424 by the director and by the governor.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2017.
