| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article 19.31, Code of Criminal Procedure, is |
|---|
| 12 | 12 | | amended by adding Subsection (b-1) to read as follows: |
|---|
| 13 | 13 | | (b-1) The court shall allow the attorney representing the |
|---|
| 14 | 14 | | state a reasonable opportunity to question a grand juror in order to |
|---|
| 15 | 15 | | determine whether the juror may be challenged under Subsection |
|---|
| 16 | 16 | | (a)(1), (2), (3), (4), (7), or (10). |

| 17 | 17 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 18 | 18 | | grand jury impaneled on or after the effective date of this Act. A |
|---|
| 19 | 19 | | grand jury impaneled before the effective date of this Act is |
|---|
| 20 | 20 | | governed by the law in effect on the date the grand jury was |
|---|
| 21 | 21 | | impaneled, and the former law is continued in effect for that |
|---|
| 22 | 22 | | purpose. |

| 23 | 23 | | SECTION 3. This Act takes effect September 1, 2017. |
