9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 264.760, Family Code, is amended to read | |
11 | 11 | as follows: | |
12 | 12 | Sec. 264.760. ELIGIBILITY FOR FOSTER CARE PAYMENTS AND | |
13 | 13 | PERMANENCY CARE ASSISTANCE. Notwithstanding any other provision of | |
14 | 14 | this subchapter, a relative or other designated caregiver [who | |
15 | 15 | becomes licensed by the department or verified by a licensed | |
16 | 16 | child-placing agency or the department to operate a foster home, | |
17 | 17 | foster group home, agency foster home, or agency foster group home | |
18 | 18 | under Chapter 42, Human Resources Code,] may elect to receive | |
19 | 19 | foster care payments in lieu of the benefits provided by this | |
20 | 20 | subchapter[, beginning with the first month in which the relative | |
21 | 21 | or other designated caregiver becomes licensed or is verified]. | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2017. |
