66 AN ACT
77 relating to the eligibility of a relative or other designated
88 caregiver of a foster child for monetary assistance.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 264.760, Family Code, is amended to read
1111 as follows:
1212 Sec. 264.760. ELIGIBILITY FOR FOSTER CARE PAYMENTS AND
1313 PERMANENCY CARE ASSISTANCE. Notwithstanding any other provision of
1414 this subchapter, a relative or other designated caregiver [who
1515 becomes licensed by the department or verified by a licensed
1616 child-placing agency or the department to operate a foster home,
1717 foster group home, agency foster home, or agency foster group home
1818 under Chapter 42, Human Resources Code,] may elect to receive
1919 foster care payments in lieu of the benefits provided by this
2020 subchapter[, beginning with the first month in which the relative
2121 or other designated caregiver becomes licensed or is verified].
2222 SECTION 2. This Act takes effect September 1, 2017.
