| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter B, Chapter 224, Transportation Code, |
|---|
| 14 | 14 | | is amended by adding Section 224.034 to read as follows: |
|---|
| 15 | 15 | | Sec. 224.034. HIGHWAY CLOSURES DURING CERTAIN PERIODS. (a) |
|---|
| 16 | 16 | | If a proposed improvement of the state highway system requires the |
|---|
| 17 | 17 | | closing of a highway, the department shall, before entering into a |
|---|
| 18 | 18 | | contract for the proposed improvement, coordinate the highway |
|---|
| 19 | 19 | | closure by communicating in person or by telephone call, e-mail, or |
|---|
| 20 | 20 | | other direct method of communication with public officials from |
|---|
| 21 | 21 | | municipalities affected by the closure to avoid any adverse |
|---|
| 22 | 22 | | economic impact on the municipalities during: |
|---|
| 23 | 23 | | (1) periods of increased travel on the state highway |
|---|
| 24 | 24 | | system, including major state and federal holidays and school |
|---|
| 25 | 25 | | holidays; and |
|---|
| 26 | 26 | | (2) other periods of high commercial activity in the |
|---|
| 27 | 27 | | state, including limited periods in which certain items are |
|---|
| 28 | 28 | | exempted from the sales tax imposed by Chapter 151, Tax Code. |
|---|
| 29 | 29 | | (b) A contract for the proposed improvement of the state |
|---|
| 30 | 30 | | highway system that requires the closing of a highway as described |
|---|
| 31 | 31 | | by Subsection (a) must include a provision identifying the days on |
|---|
| 32 | 32 | | which the highway may not be closed. |
|---|
| 33 | 33 | | (c) The department shall submit an annual report to the |
|---|
| 34 | 34 | | governor, the lieutenant governor, the speaker of the house of |
|---|
| 35 | 35 | | representatives, and each member of the legislature detailing all |
|---|
| 36 | 36 | | highway closures during periods listed in Subsection (a) and the |
|---|
| 37 | 37 | | estimated economic impact of those closures. |

| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2017. |
