1010 relating to the economic impact of closures on the state highway
1111 system during certain periods.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 224, Transportation Code,
1414 is amended by adding Section 224.034 to read as follows:
1515 Sec. 224.034. HIGHWAY CLOSURES DURING CERTAIN PERIODS. (a)
1616 If a proposed improvement of the state highway system requires the
1717 closing of a highway, the department shall, before entering into a
1818 contract for the proposed improvement, coordinate the highway
1919 closure by communicating in person or by telephone call, e-mail, or
2020 other direct method of communication with public officials from
2121 municipalities affected by the closure to avoid any adverse
2222 economic impact on the municipalities during:
2323 (1) periods of increased travel on the state highway
2424 system, including major state and federal holidays and school
2525 holidays; and
2626 (2) other periods of high commercial activity in the
2727 state, including limited periods in which certain items are
2828 exempted from the sales tax imposed by Chapter 151, Tax Code.
2929 (b) A contract for the proposed improvement of the state
3030 highway system that requires the closing of a highway as described
3131 by Subsection (a) must include a provision identifying the days on
3232 which the highway may not be closed.
3333 (c) The department shall submit an annual report to the
3434 governor, the lieutenant governor, the speaker of the house of
3535 representatives, and each member of the legislature detailing all
3636 highway closures during periods listed in Subsection (a) and the
3737 estimated economic impact of those closures.
3838 SECTION 2. This Act takes effect September 1, 2017.
