55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of school marshal grant programs by
88 the criminal justice division of the governor's office and the
99 adoption of a school marshals promotion program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 37.0811, Education Code, is amended by
1212 adding Subsection (i) to read as follows:
1313 (i) A school district or open-enrollment charter school may
1414 request a grant under:
1515 (1) the school marshal support grant program
1616 established under Section 772.0064, Government Code; and
1717 (2) the school marshal notice grant program
1818 established under Section 772.0065, Government Code.
1919 SECTION 2. Subchapter A, Chapter 772, Government Code, is
2020 amended by adding Sections 772.0064 and 772.0065 to read as
2121 follows:
2222 Sec. 772.0064. SCHOOL MARSHAL SUPPORT GRANT PROGRAM. (a)
2323 From funds appropriated to the governor for that purpose, the
2424 criminal justice division established under Section 772.006 shall
2525 establish a grant program under which grants are awarded to a school
2626 district or open-enrollment charter school to support the
2727 appointment of a school marshal by the district or school.
2828 (b) Grant money awarded under this section may be used by
2929 the school district or open-enrollment charter school to pay the
3030 costs of providing an appointed school marshal with:
3131 (1) training;
3232 (2) a handgun to be carried by the school marshal in
3333 compliance with Section 37.0811, Education Code, and the written
3434 regulations adopted by a school under that section; and
3535 (3) the appropriate ammunition for use by the school
3636 marshal in compliance with Section 37.0811, Education Code, and the
3737 written regulations adopted by a school under that section.
3838 (c) The criminal justice division shall award grants to
3939 school districts and open-enrollment charter schools under this
4040 section until the funds appropriated for the grant program are
4141 expended.
4242 Sec. 772.0065. SCHOOL MARSHAL NOTICE GRANT PROGRAM. (a)
4343 From funds appropriated to the governor for that purpose, the
4444 criminal justice division established under Section 772.006 shall
4545 establish a grant program under which grants are awarded to enable a
4646 school district or open-enrollment charter school that has
4747 appointed a school marshal to provide notice about the school
4848 marshal.
4949 (b) Grant money awarded under this section may be used by
5050 the school district or open-enrollment charter school to pay the
5151 costs of posting signage or otherwise providing notice in multiple
5252 places on a campus at which a school marshal is an employee to
5353 provide notice that an employee of the campus is a school marshal
5454 authorized to carry or possess a handgun on the campus.
5555 (c) The criminal justice division shall award grants to
5656 school districts and open-enrollment charter schools under this
5757 section until the funds appropriated for the grant program are
5858 expended.
5959 SECTION 3. Subchapter F, Chapter 1701, Occupations Code, is
6060 amended by adding Section 1701.2601 to read as follows:
6161 Sec. 1701.2601. SCHOOL MARSHALS PROMOTION PROGRAM. From
6262 funds appropriated for the purpose, the commission shall develop
6363 and implement a program to:
6464 (1) notify school districts and open-enrollment
6565 charter schools about the authority to appoint school marshals
6666 under Section 37.0811, Education Code;
6767 (2) provide education about:
6868 (A) the benefits of school marshals; and
6969 (B) the school marshal support grant program
7070 under Section 772.0064, Government Code, and the school marshal
7171 notice grant program under Section 772.0065, Government Code; and
7272 (3) encourage schools to appoint school marshals.
7373 SECTION 4. This Act takes effect September 1, 2017.
