| 7 | 7 | | relating to the establishment of school marshal grant programs by |

| 8 | 8 | | the criminal justice division of the governor's office and the |
|---|
| 9 | 9 | | adoption of a school marshals promotion program. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 37.0811, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (i) to read as follows: |
|---|
| 13 | 13 | | (i) A school district or open-enrollment charter school may |
|---|
| 14 | 14 | | request a grant under: |
|---|
| 15 | 15 | | (1) the school marshal support grant program |
|---|
| 16 | 16 | | established under Section 772.0064, Government Code; and |
|---|
| 17 | 17 | | (2) the school marshal notice grant program |
|---|
| 18 | 18 | | established under Section 772.0065, Government Code. |
|---|
| 19 | 19 | | SECTION 2. Subchapter A, Chapter 772, Government Code, is |
|---|
| 20 | 20 | | amended by adding Sections 772.0064 and 772.0065 to read as |
|---|
| 21 | 21 | | follows: |
|---|
| 22 | 22 | | Sec. 772.0064. SCHOOL MARSHAL SUPPORT GRANT PROGRAM. (a) |
|---|
| 23 | 23 | | From funds appropriated to the governor for that purpose, the |
|---|
| 24 | 24 | | criminal justice division established under Section 772.006 shall |
|---|
| 25 | 25 | | establish a grant program under which grants are awarded to a school |
|---|
| 26 | 26 | | district or open-enrollment charter school to support the |
|---|
| 27 | 27 | | appointment of a school marshal by the district or school. |
|---|
| 28 | 28 | | (b) Grant money awarded under this section may be used by |
|---|
| 29 | 29 | | the school district or open-enrollment charter school to pay the |
|---|
| 30 | 30 | | costs of providing an appointed school marshal with: |
|---|
| 31 | 31 | | (1) training; |
|---|
| 32 | 32 | | (2) a handgun to be carried by the school marshal in |
|---|
| 33 | 33 | | compliance with Section 37.0811, Education Code, and the written |
|---|
| 34 | 34 | | regulations adopted by a school under that section; and |
|---|
| 35 | 35 | | (3) the appropriate ammunition for use by the school |
|---|
| 36 | 36 | | marshal in compliance with Section 37.0811, Education Code, and the |
|---|
| 37 | 37 | | written regulations adopted by a school under that section. |
|---|
| 38 | 38 | | (c) The criminal justice division shall award grants to |
|---|
| 39 | 39 | | school districts and open-enrollment charter schools under this |
|---|
| 40 | 40 | | section until the funds appropriated for the grant program are |
|---|
| 41 | 41 | | expended. |
|---|
| 42 | 42 | | Sec. 772.0065. SCHOOL MARSHAL NOTICE GRANT PROGRAM. (a) |
|---|
| 43 | 43 | | From funds appropriated to the governor for that purpose, the |
|---|
| 44 | 44 | | criminal justice division established under Section 772.006 shall |
|---|
| 45 | 45 | | establish a grant program under which grants are awarded to enable a |
|---|
| 46 | 46 | | school district or open-enrollment charter school that has |
|---|
| 47 | 47 | | appointed a school marshal to provide notice about the school |
|---|
| 48 | 48 | | marshal. |
|---|
| 49 | 49 | | (b) Grant money awarded under this section may be used by |
|---|
| 50 | 50 | | the school district or open-enrollment charter school to pay the |
|---|
| 51 | 51 | | costs of posting signage or otherwise providing notice in multiple |
|---|
| 52 | 52 | | places on a campus at which a school marshal is an employee to |
|---|
| 53 | 53 | | provide notice that an employee of the campus is a school marshal |
|---|
| 54 | 54 | | authorized to carry or possess a handgun on the campus. |
|---|
| 55 | 55 | | (c) The criminal justice division shall award grants to |
|---|
| 56 | 56 | | school districts and open-enrollment charter schools under this |
|---|
| 57 | 57 | | section until the funds appropriated for the grant program are |
|---|
| 58 | 58 | | expended. |
|---|
| 59 | 59 | | SECTION 3. Subchapter F, Chapter 1701, Occupations Code, is |
|---|
| 60 | 60 | | amended by adding Section 1701.2601 to read as follows: |
|---|
| 61 | 61 | | Sec. 1701.2601. SCHOOL MARSHALS PROMOTION PROGRAM. From |
|---|
| 62 | 62 | | funds appropriated for the purpose, the commission shall develop |
|---|
| 63 | 63 | | and implement a program to: |
|---|
| 64 | 64 | | (1) notify school districts and open-enrollment |
|---|
| 65 | 65 | | charter schools about the authority to appoint school marshals |
|---|
| 66 | 66 | | under Section 37.0811, Education Code; |
|---|
| 67 | 67 | | (2) provide education about: |
|---|
| 68 | 68 | | (A) the benefits of school marshals; and |
|---|
| 69 | 69 | | (B) the school marshal support grant program |
|---|
| 70 | 70 | | under Section 772.0064, Government Code, and the school marshal |
|---|
| 71 | 71 | | notice grant program under Section 772.0065, Government Code; and |
|---|
| 72 | 72 | | (3) encourage schools to appoint school marshals. |
|---|
| 73 | 73 | | SECTION 4. This Act takes effect September 1, 2017. |
