66 AN ACT
77 relating to public school accountability, including assessment of
88 students and appraisal of teachers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.351(a), Education Code, is amended to
1111 read as follows:
1212 (a) The commissioner shall adopt a recommended appraisal
1313 process and criteria on which to appraise the performance of
1414 teachers. The criteria must be based on observable, job-related
1515 behavior, including:
1616 (1) teachers' implementation of discipline management
1717 procedures; and
1818 (2) the performance of teachers' students, provided
1919 that consideration of student performance is not based in any part
2020 on student performance on assessment instruments administered
2121 under Section 39.023.
2222 SECTION 2. Section 39.023(a), Education Code, as effective
2323 September 1, 2017, is amended to read as follows:
2424 (a) The agency shall adopt or develop appropriate
2525 criterion-referenced assessment instruments designed to assess
2626 essential knowledge and skills in reading, [writing,] mathematics,
2727 [social studies,] and science. Except as provided by Subsection
2828 (a-2), all students, other than students assessed under Subsection
2929 (b) or (l) or exempted under Section 39.027, shall be assessed in:
3030 (1) mathematics, annually in grades three through
3131 seven without the aid of technology and in grade eight with the aid
3232 of technology on any assessment instrument that includes algebra;
3333 (2) reading, annually in grades three through eight;
3434 and
3535 (3) [writing, including spelling and grammar, in
3636 grades four and seven;
3737 [(4) social studies, in grade eight;
3838 [(5)] science, in grades five and eight[; and
3939 [(6) any other subject and grade required by federal
4040 law].
4141 SECTION 3. Section 39.023(c), Education Code, is amended to
4242 read as follows:
4343 (c) The agency shall also adopt end-of-course assessment
4444 instruments for secondary-level courses in reading, mathematics,
4545 and science only as necessary to comply with the Every Student
4646 Succeeds Act (20 U.S.C. Section 6301 et seq.) to be administered
4747 only as necessary to meet the minimum requirements of that Act
4848 [Algebra I, biology, English I, English II, and United States
4949 history. The Algebra I end-of-course assessment instrument must be
5050 administered with the aid of technology. The English I and English
5151 II end-of-course assessment instruments must each assess essential
5252 knowledge and skills in both reading and writing in the same
5353 assessment instrument and must provide a single score]. A school
5454 district shall comply with State Board of Education rules regarding
5555 administration of the assessment instruments adopted under [listed
5656 in] this subsection. If a student is in a special education program
5757 under Subchapter A, Chapter 29, the student's admission, review,
5858 and dismissal committee shall determine whether any allowable
5959 modification is necessary in administering to the student an
6060 assessment instrument required under this subsection. The State
6161 Board of Education shall administer the assessment instruments.
6262 [The State Board of Education shall adopt a schedule for the
6363 administration of end-of-course assessment instruments that
6464 complies with the requirements of Subsection (c-3).]
6565 SECTION 4. Section 39.023(c-3), Education Code, as
6666 effective September 1, 2017, is amended to read as follows:
6767 (c-3) The State Board of Education, with input from school
6868 districts, shall adopt [In adopting] a schedule for the
6969 administration of assessment instruments under this section that
7070 minimizes the disruption of classroom instruction [, the State
7171 Board of Education shall require:
7272 [(1) assessment instruments administered under
7373 Subsection (a) to be administered on a schedule so that the first
7474 assessment instrument is administered at least two weeks later than
7575 the date on which the first assessment instrument was administered
7676 under Subsection (a) during the 2006-2007 school year; and
7777 [(2) the spring administration of end-of-course
7878 assessment instruments under Subsection (c) to occur in each school
7979 district not earlier than the first full week in May, except that
8080 the spring administration of the end-of-course assessment
8181 instruments in English I and English II must be permitted to occur
8282 at an earlier date].
8383 SECTION 5. Section 39.023, Education Code, is amended by
8484 adding Subsection (q) to read as follows:
8585 (q) Notwithstanding any provision of this section or other
8686 law, if changes made to the Every Student Succeeds Act (20 U.S.C.
8787 Section 6301 et seq.) reduce the number or frequency of assessment
8888 instruments required to be administered to students, the State
8989 Board of Education shall adopt rules reducing the number or
9090 frequency of assessment instruments administered to students under
9191 state law, and the commissioner shall ensure that students are not
9292 assessed in subject areas or in grades that are no longer required
9393 to meet the minimum requirements of that Act.
9494 SECTION 6. Subchapter B, Chapter 39, Education Code, is
9595 amended by adding Section 39.040 to read as follows:
9696 Sec. 39.040. ALTERNATIVE ASSESSMENT INSTRUMENTS. (a) The
9797 commissioner by rule shall adopt procedures to identify nationally
9898 recognized, norm-referenced assessment instruments as additional
9999 alternative assessment instruments that may be used to evaluate
100100 student achievement for purposes of complying with accountability
101101 requirements under this chapter.
102102 (b) Additional alternative assessment instruments
103103 identified as provided by Subsection (a) may be used:
104104 (1) for grades three through eight, provided that the
105105 commissioner obtains any necessary waiver from the application of
106106 any conflicting federal law or regulation as provided by Subsection
107107 (d); and
108108 (2) for secondary-level courses.
109109 (c) The procedures adopted to identify all additional
110110 alternative assessment instruments under Subsection (a) must be
111111 consistent with the federal procedures required by the Every
112112 Student Succeeds Act (20 U.S.C. Section 6311) for state approval of
113113 nationally recognized high school academic assessment instruments
114114 that are available for local selection, including requiring each
115115 additional alternative assessment instrument identified to be
116116 aligned with the essential knowledge and skills for the appropriate
117117 grade level in the subject assessed.
118118 (d) For purposes of using additional alternative assessment
119119 instruments in grades three through eight, the commissioner shall
120120 seek a waiver from the application of any conflicting federal law or
121121 regulation as a result of the use of multiple assessment
122122 instruments for assessing students in the same grade.
123123 SECTION 7. Section 39.053(c), Education Code, is amended to
124124 read as follows:
125125 (c) School districts and campuses must be evaluated based on
126126 five domains of indicators of achievement adopted under this
127127 section that include:
128128 (1) in the first domain, the results of:
129129 (A) assessment instruments required under
130130 Sections 39.023(a), (c), and (l), including the results of
131131 assessment instruments required for graduation retaken by a
132132 student, aggregated across grade levels by subject area, including:
133133 (i) for the performance standard determined
134134 by the commissioner under Section 39.0241(a), the percentage of
135135 students who performed satisfactorily on the assessment
136136 instruments, aggregated across grade levels by subject area; and
137137 (ii) for the college readiness performance
138138 standard as determined under Section 39.0241, the percentage of
139139 students who performed satisfactorily on the assessment
140140 instruments, aggregated across grade levels by subject area; and
141141 (B) assessment instruments required under
142142 Section 39.023(b), aggregated across grade levels by subject area,
143143 including the percentage of students who performed satisfactorily
144144 on the assessment instruments, as determined by the performance
145145 standard adopted by the agency, aggregated across grade levels by
146146 subject area;
147147 (2) in the second domain:
148148 (A) for assessment instruments under Subdivision
149149 (1)(A):
150150 (i) for the performance standard determined
151151 by the commissioner under Section 39.0241(a), the percentage of
152152 students who met the standard for annual improvement on the
153153 assessment instruments, as determined by the commissioner by rule
154154 or by the method for measuring annual improvement under Section
155155 39.034, aggregated across grade levels by subject area; and
156156 (ii) for the college readiness performance
157157 standard as determined under Section 39.0241, the percentage of
158158 students who met the standard for annual improvement on the
159159 assessment instruments, as determined by the commissioner by rule
160160 or by the method for measuring annual improvement under Section
161161 39.034, aggregated across grade levels by subject area; and
162162 (B) for assessment instruments under Subdivision
163163 (1)(B), the percentage of students who met the standard for annual
164164 improvement on the assessment instruments, as determined by the
165165 commissioner by rule or by the method for measuring annual
166166 improvement under Section 39.034, aggregated across grade levels by
167167 subject area;
168168 (3) in the third domain, the student academic
169169 achievement differentials among students from different racial and
170170 ethnic groups and socioeconomic backgrounds;
171171 (4) in the fourth domain:
172172 (A) for evaluating the performance of high school
173173 campuses and districts that include high school campuses:
174174 (i) dropout rates, including dropout rates
175175 and district completion rates for grade levels 9 through 12,
176176 computed in accordance with standards and definitions adopted by
177177 the National Center for Education Statistics of the United States
178178 Department of Education;
179179 (ii) high school graduation rates, computed
180180 in accordance with standards and definitions adopted in compliance
181181 with the Every Student Succeeds Act [No Child Left Behind Act of
182182 2001] (20 U.S.C. Section 6301 et seq.);
183183 (iii) the percentage of students who
184184 successfully completed the curriculum requirements for the
185185 distinguished level of achievement under the foundation high school
186186 program;
187187 (iv) the percentage of students who
188188 successfully completed the curriculum requirements for an
189189 endorsement under Section 28.025(c-1);
190190 (v) the percentage of students who
191191 completed a coherent sequence of career and technical courses;
192192 (vi) the percentage of students who satisfy
193193 the Texas Success Initiative (TSI) college readiness benchmarks
194194 prescribed by the Texas Higher Education Coordinating Board under
195195 Section 51.3062(f) on an assessment instrument in reading, writing,
196196 or mathematics designated by the Texas Higher Education
197197 Coordinating Board under Section 51.3062(c);
198198 (vii) the percentage of students who earn
199199 at least 12 hours of postsecondary credit required for the
200200 foundation high school program under Section 28.025 or to earn an
201201 endorsement under Section 28.025(c-1);
202202 (viii) the percentage of students who have
203203 completed an advanced placement course;
204204 (ix) the percentage of students who enlist
205205 in the armed forces of the United States; and
206206 (x) the percentage of students who earn an
207207 industry certification;
208208 (B) for evaluating the performance of middle and
209209 junior high school and elementary school campuses and districts
210210 that include those campuses:
211211 (i) student attendance; and
212212 (ii) for middle and junior high school
213213 campuses:
214214 (a) dropout rates, computed in the
215215 manner described by Paragraph (A)(i); and
216216 (b) the percentage of students in
217217 grades seven and eight who receive instruction in preparing for
218218 high school, college, and a career that includes information
219219 regarding the creation of a high school personal graduation plan
220220 under Section 28.02121, the distinguished level of achievement
221221 described by Section 28.025(b-15), each endorsement described by
222222 Section 28.025(c-1), college readiness standards, and potential
223223 career choices and the education needed to enter those careers; and
224224 (C) any additional indicators of student
225225 achievement not associated with performance on standardized
226226 assessment instruments determined appropriate for consideration by
227227 the commissioner in consultation with educators, parents, business
228228 and industry representatives, and employers; and
229229 (5) in the fifth domain, the following [three]
230230 programs or specific categories of performance related to community
231231 and student engagement under Section 39.0545(b)(1) locally
232232 [selected and] evaluated as provided by Section 39.0546:
233233 (A) wellness and physical education; and
234234 (B) community and parental involvement.
235235 SECTION 8. Section 39.054(a-1), Education Code, is amended
236236 to read as follows:
237237 (a-1) For purposes of assigning an overall performance
238238 rating under Subsection (a), the commissioner shall attribute:
239239 (1) 25 [55] percent of the performance evaluation to
240240 the achievement indicators for the first, second, and third domains
241241 under Sections 39.053(c)(1)-(3);
242242 (2) for middle and junior high school and elementary
243243 campuses and districts that include only those campuses:
244244 (A) 10 percent of the performance evaluation to
245245 the dropout rate indicator described by Section
246246 39.053(c)(4)(B)(ii)(a); and
247247 (B) [,] 35 percent to the remaining [of the
248248 performance evaluation to the] applicable achievement indicators
249249 for the fourth domain under Section 39.053(c)(4);
250250 (3) for high school campuses and districts that
251251 include those campuses:
252252 (A) 10 percent of the performance evaluation to
253253 the dropout [high school graduation] rate [achievement] indicator
254254 described by Section 39.053(c)(4)(A)(i) [39.053(c)(4)(A)(ii)]; and
255255 (B) 35 [25] percent to the remaining applicable
256256 achievement indicators for the fourth domain under Section
257257 39.053(c)(4); and
258258 (4) for [10 percent of the performance evaluation to]
259259 the locally [selected and] evaluated achievement indicators
260260 provided for under the fifth domain under Section 39.053(c)(5):
261261 (A) 15 percent of the performance evaluation to
262262 the wellness and physical education indicator under Section
263263 39.053(c)(5)(A); and
264264 (B) 15 percent of the performance evaluation to
265265 the community and parental involvement indicator under Section
266266 39.053(c)(5)(B).
267267 SECTION 9. Section 39.0546(a), Education Code, is amended
268268 to read as follows:
269269 (a) For purposes of including the local evaluation of
270270 districts and campuses under Section 39.053(c)(5) and assigning an
271271 overall rating under Section 39.054, before the beginning of each
272272 school year:
273273 (1) each school district shall:
274274 (A) [select and] report to the agency the
275275 following [three] programs or categories under Section
276276 39.0545(b)(1)[, as added by Chapter 211 (H.B. 5), Acts of the 83rd
277277 Legislature, Regular Session, 2013,] under which the district will
278278 evaluate district performance:
279279 (i) wellness and physical education under
280280 Section 39.0545(b)(1)(B); and
281281 (ii) community and parental involvement
282282 under Section 39.0545(b)(1)(C);
283283 (B) submit to the agency the criteria the
284284 district will use to evaluate district performance and assign the
285285 district a performance rating; and
286286 (C) make the information described by Paragraphs
287287 (A) and (B) available on the district's Internet website; and
288288 (2) each campus shall:
289289 (A) [select and] report to the agency the [three]
290290 programs or categories described by Subdivision (1)(A) [under
291291 Section 39.0545(b)(1), as added by Chapter 211 (H.B. 5), Acts of the
292292 83rd Legislature, Regular Session, 2013,] under which the campus
293293 will evaluate campus performance;
294294 (B) submit to the agency the criteria the campus
295295 will use to evaluate campus performance and assign the campus a
296296 performance rating; and
297297 (C) make the information described by Paragraphs
298298 (A) and (B) available on the Internet website of the campus.
299299 SECTION 10. Section 39.203(c), Education Code, is amended
300300 to read as follows:
301301 (c) In addition to the distinction designations described
302302 by Subsections (a) and (b), a campus that satisfies the criteria
303303 developed under Section 39.204 shall be awarded a distinction
304304 designation by the commissioner for outstanding performance in
305305 academic achievement in reading [English language arts],
306306 mathematics, or science[, or social studies].
307307 SECTION 11. Section 39.02301, Education Code, is repealed.
308308 SECTION 12. Not later than September 1, 2018, the
309309 commissioner of education shall:
310310 (1) adopt rules regarding alternative assessment
311311 instruments as required by Section 39.040, Education Code, as added
312312 by this Act; and
313313 (2) request from the United States Department of
314314 Education a waiver from the application of any conflicting federal
315315 law or regulation as required by Section 39.040(d), Education Code,
316316 as added by this Act, or a written notification that a waiver is not
317317 required.
318318 SECTION 13. This Act applies beginning with the 2017-2018
319319 school year.
320320 SECTION 14. This Act takes effect immediately if it
321321 receives a vote of two-thirds of all the members elected to each
322322 house, as provided by Section 39, Article III, Texas Constitution.
323323 If this Act does not receive the vote necessary for immediate
324324 effect, this Act takes effect September 1, 2017.
