| 7 | 7 | | relating to the carrying or storage of a handgun by a firefighter at |

| 8 | 8 | | the fire station to which the firefighter is assigned. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 180, Local Government Code, is amended |
|---|
| 11 | 11 | | by adding Section 180.008 to read as follows: |
|---|
| 12 | 12 | | Sec. 180.008. CARRYING AND STORAGE OF HANDGUN BY CERTAIN |
|---|
| 13 | 13 | | FIREFIGHTERS. (a) In this section, "firefighter" means a |
|---|
| 14 | 14 | | permanent, paid employee of the fire department of a political |
|---|
| 15 | 15 | | subdivision. The term does not include a volunteer firefighter. |
|---|
| 16 | 16 | | (b) A political subdivision that employs a firefighter may |
|---|
| 17 | 17 | | not prohibit a firefighter who holds a license to carry a handgun |
|---|
| 18 | 18 | | under Subchapter H, Chapter 411, Government Code, from carrying or |
|---|
| 19 | 19 | | storing a handgun at the fire station to which the firefighter is |
|---|
| 20 | 20 | | assigned during the firefighter's duty hours. |
|---|
| 21 | 21 | | SECTION 2. Section 180.008, Local Government Code, as added |
|---|
| 22 | 22 | | by this Act, applies to a rule, ordinance, order, resolution, or |
|---|
| 23 | 23 | | other regulation adopted before, on, or after the effective date of |
|---|
| 24 | 24 | | this Act. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2017. |
