55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reporting by political subdivisions regarding the
88 receipt or expenditure of federal funds.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 140, Local Government Code, is amended
1111 by adding Section 140.012 to read as follows:
1212 Sec. 140.012. RECEIPT AND EXPENDITURE OF FEDERAL FUNDS. A
1313 political subdivision that receives or expends a federal grant or
1414 other federal funds that have not been appropriated by the
1515 legislature shall report to the Legislative Budget Board, the
1616 comptroller, and the governor not later than the 90th day of the
1717 political subdivision's fiscal year:
1818 (1) the total amount of federal funds received or
1919 expended in the previous fiscal year; and
2020 (2) the use or proposed use of those federal funds.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2017.
