55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prima facie speed limit in an urban district.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 545.352(b), Transportation Code, is
1010 amended to read as follows:
1111 (b) Unless a special hazard exists that requires a slower
1212 speed for compliance with Section 545.351(b), the following speeds
1313 are lawful:
1414 (1) 25 [30] miles per hour in an urban district on a
1515 street other than an alley and 15 miles per hour in an alley;
1616 (2) except as provided by Subdivision (4), 70 miles
1717 per hour on a highway numbered by this state or the United States
1818 outside an urban district, including a farm-to-market or
1919 ranch-to-market road;
2020 (3) except as provided by Subdivision (4), 60 miles
2121 per hour on a highway that is outside an urban district and not a
2222 highway numbered by this state or the United States;
2323 (4) outside an urban district:
2424 (A) 60 miles per hour if the vehicle is a school
2525 bus that has passed a commercial motor vehicle inspection under
2626 Section 548.201 and is on a highway numbered by the United States or
2727 this state, including a farm-to-market road; or
2828 (B) 50 miles per hour if the vehicle is a school
2929 bus that:
3030 (i) has not passed a commercial motor
3131 vehicle inspection under Section 548.201; or
3232 (ii) is traveling on a highway not numbered
3333 by the United States or this state;
3434 (5) on a beach, 15 miles per hour; or
3535 (6) on a county road adjacent to a public beach, 15
3636 miles per hour, if declared by the commissioners court of the
3737 county.
3838 SECTION 2. The change in law made by this Act applies only
3939 to an offense committed on or after the effective date of this Act.
4040 An offense committed before the effective date of this Act is
4141 governed by the law in effect on the date the offense was committed,
4242 and the former law is continued in effect for that purpose. For
4343 purposes of this section, an offense was committed before the
4444 effective date of this Act if any element of the offense occurred
4545 before that date.
4646 SECTION 3. This Act takes effect September 1, 2017.
