77 AN ACT
88 relating to the capacity of certain minors to consent to
99 examination or medical treatment related to contraception.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 32.003, Family Code, is amended by
1212 amending Subsection (a) and adding Subsection (g) to read as
1313 follows:
1414 (a) A child may consent to medical, dental, psychological,
1515 and surgical treatment for the child by a licensed physician or
1616 dentist if the child:
1717 (1) is on active duty with the armed services of the
1818 United States of America;
1919 (2) is:
2020 (A) 16 years of age or older and resides separate
2121 and apart from the child's parents, managing conservator, or
2222 guardian, with or without the consent of the parents, managing
2323 conservator, or guardian and regardless of the duration of the
2424 residence; and
2525 (B) managing the child's own financial affairs,
2626 regardless of the source of the income;
2727 (3) consents to the diagnosis and treatment of an
2828 infectious, contagious, or communicable disease that is required by
2929 law or a rule to be reported by the licensed physician or dentist to
3030 a local health officer or the [Texas] Department of State Health
3131 Services, including all diseases within the scope of Section
3232 81.041, Health and Safety Code;
3333 (4) is unmarried and pregnant and consents to
3434 hospital, medical, or surgical treatment, other than abortion,
3535 related to the pregnancy;
3636 (5) consents to examination and treatment for drug or
3737 chemical addiction, drug or chemical dependency, or any other
3838 condition directly related to drug or chemical use;
3939 (6) is unmarried, is the parent of a child, and has
4040 actual custody of his or her child and consents to medical, dental,
4141 psychological, or surgical treatment for the child; [or]
4242 (7) is serving a term of confinement in a facility
4343 operated by or under contract with the Texas Department of Criminal
4444 Justice, unless the treatment would constitute a prohibited
4545 practice under Section 164.052(a)(19), Occupations Code; or
4646 (8) is unmarried, is the mother of a child, and
4747 consents to examination or medical treatment, other than abortion,
4848 related to contraception.
4949 (g) In this section, "contraception" means any method of
5050 preventing pregnancy that is approved by the United States Food and
5151 Drug Administration.
5252 SECTION 2. This Act takes effect September 1, 2017.
