9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 255, Election Code, is amended by adding | |
11 | 11 | Section 255.010 to read as follows: | |
12 | 12 | Sec. 255.010. REQUIRED DISCLOSURE ON SLATE MAILER. (a) In | |
13 | 13 | this section, "slate mailer" means a mass mailing that supports or | |
14 | 14 | opposes four or more candidates. | |
15 | 15 | (b) This section does not apply to a slate mailer produced | |
16 | 16 | by a general-purpose committee. | |
17 | 17 | (c) In addition to the disclosure statement required by | |
18 | 18 | Section 255.001 or 255.008, as applicable, the first page of a slate | |
19 | 19 | mailer shall indicate the full name and address of each person with | |
20 | 20 | final decision-making authority as to which candidates are | |
21 | 21 | supported or opposed in the slate mailer. | |
22 | 22 | (d) A person may not knowingly cause to be published or | |
23 | 23 | distributed a slate mailer that does not include the disclosure | |
24 | 24 | required by Subsection (c). | |
25 | 25 | (e) A person who violates this section is liable to this | |
26 | 26 | state for a civil penalty in an amount determined by the commission | |
27 | 27 | not to exceed $4,000. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2017. |
