77 relating to required disclosures on certain mailed political
88 advertising; providing a civil penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 255, Election Code, is amended by adding
1111 Section 255.010 to read as follows:
1212 Sec. 255.010. REQUIRED DISCLOSURE ON SLATE MAILER. (a) In
1313 this section, "slate mailer" means a mass mailing that supports or
1414 opposes four or more candidates.
1515 (b) This section does not apply to a slate mailer produced
1616 by a general-purpose committee.
1717 (c) In addition to the disclosure statement required by
1818 Section 255.001 or 255.008, as applicable, the first page of a slate
1919 mailer shall indicate the full name and address of each person with
2020 final decision-making authority as to which candidates are
2121 supported or opposed in the slate mailer.
2222 (d) A person may not knowingly cause to be published or
2323 distributed a slate mailer that does not include the disclosure
2424 required by Subsection (c).
2525 (e) A person who violates this section is liable to this
2626 state for a civil penalty in an amount determined by the commission
2727 not to exceed $4,000.
2828 SECTION 2. This Act takes effect September 1, 2017.
