| 7 | 7 | | relating to the membership of the Texas Transportation Commission. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 201.051(a) and (b), Transportation |
|---|
| 10 | 10 | | Code, are amended to read as follows: |
|---|
| 11 | 11 | | (a) The Texas Transportation Commission consists of seven |
|---|
| 12 | 12 | | [five] members appointed by the governor with the advice and |
|---|
| 13 | 13 | | consent of the senate. |
|---|
| 14 | 14 | | (b) The members shall be appointed from [to reflect the] |
|---|
| 15 | 15 | | diverse geographic regions and population groups of this state. |
|---|
| 16 | 16 | | One member must reside in a rural area and be a registered voter of a |
|---|
| 17 | 17 | | county with a population of less than 150,000. |
|---|
| 18 | 18 | | SECTION 2. Section 201.052, Transportation Code, is amended |
|---|
| 19 | 19 | | to read as follows: |
|---|
| 20 | 20 | | Sec. 201.052. TERMS. Members of the commission serve |
|---|
| 21 | 21 | | staggered six-year terms, with the terms of either two [one] or |
|---|
| 22 | 22 | | three [two] members expiring February 1 of each odd-numbered year. |
|---|
| 23 | 23 | | SECTION 3. Promptly after this Act takes effect, the |
|---|
| 24 | 24 | | governor shall appoint two additional members to the Texas |
|---|
| 25 | 25 | | Transportation Commission. In appointing those members, the |
|---|
| 26 | 26 | | governor shall appoint one person to a term expiring February 1, |
|---|
| 27 | 27 | | 2021, and one person to a term expiring February 1, 2023. |
|---|
| 28 | 28 | | SECTION 4. The changes in law made by this Act in the |
|---|
| 29 | 29 | | qualifications of members of the Texas Transportation Commission do |
|---|
| 30 | 30 | | not affect the entitlement of a member serving on the commission |
|---|
| 31 | 31 | | immediately before the effective date of this Act to continue to |
|---|
| 32 | 32 | | serve for the remainder of the member's term. As the terms of |
|---|
| 33 | 33 | | commission members expire, the governor shall appoint or reappoint |
|---|
| 34 | 34 | | a member who has the qualifications required for a member under |
|---|
| 35 | 35 | | Section 201.051, Transportation Code, as amended by this Act. |

| 36 | 36 | | SECTION 5. This Act takes effect September 1, 2017. |
