7 | 7 | | relating to the membership, powers, and duties of the Sunset |
---|
8 | 8 | | Advisory Commission. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Chapter 325, Government Code, is amended by |
---|
11 | 11 | | adding Section 325.0025 to read as follows: |
---|
12 | 12 | | Sec. 325.0025. PURPOSE OF SUNSET ADVISORY COMMISSION. The |
---|
13 | 13 | | primary purpose of the commission is to review state agencies to |
---|
14 | 14 | | evaluate the need for the agency and determine whether the agency or |
---|
15 | 15 | | the agency's functions should be abolished or consolidated in |
---|
16 | 16 | | order to reduce the cost of state government operations. |
---|
17 | 17 | | SECTION 2. Sections 325.003(a) and (j), Government Code, |
---|
18 | 18 | | are amended to read as follows: |
---|
19 | 19 | | (a) The Sunset Advisory Commission consists of five members |
---|
20 | 20 | | of the senate and two [one] public members [member] appointed by the |
---|
21 | 21 | | lieutenant governor, [and] five members of the house of |
---|
22 | 22 | | representatives and two [one] public members [member] appointed by |
---|
23 | 23 | | the speaker of the house, and one public member appointed by the |
---|
24 | 24 | | governor who may only vote on the commission's recommendations that |
---|
25 | 25 | | do not require a statutory change. The lieutenant governor and the |
---|
26 | 26 | | speaker of the house may serve as one of the legislative appointees. |
---|
27 | 27 | | (j) Eight [Seven] members of the commission constitute a |
---|
28 | 28 | | quorum. A final action or recommendation may not be made unless |
---|
29 | 29 | | approved by a record vote of a majority of members appointed by the |
---|
30 | 30 | | lieutenant governor and the speaker of the house. All other actions |
---|
31 | 31 | | by the commission shall be decided by a majority of the members |
---|
32 | 32 | | present and voting. |
---|
33 | 33 | | SECTION 3. Section 325.015(a), Government Code, is amended |
---|
34 | 34 | | to read as follows: |
---|
35 | 35 | | (a) During the regular session immediately before the |
---|
36 | 36 | | abolition of a state agency and its [or an] advisory committees |
---|
37 | 37 | | [committee] that are [is] subject to this chapter, the legislature |
---|
38 | 38 | | by law may continue the agency and any [or] advisory committee of |
---|
39 | 39 | | the agency for a period not to exceed: |
---|
40 | 40 | | (1) eight years for an agency and any advisory |
---|
41 | 41 | | committee of the agency if the agency has 200 or more full-time |
---|
42 | 42 | | equivalent employees; and |
---|
43 | 43 | | (2) 10 [12] years for an agency and any advisory |
---|
44 | 44 | | committee of the agency if the agency has less than 200 full-time |
---|
45 | 45 | | equivalent employees. |
---|
46 | 46 | | SECTION 4. The governor, lieutenant governor, and speaker |
---|
47 | 47 | | of the house of representatives, as soon as possible after the |
---|
48 | 48 | | effective date of this Act, shall appoint public members to serve |
---|
49 | 49 | | initial terms on the Sunset Advisory Commission under Section |
---|
50 | 50 | | 325.003, Government Code, as amended by this Act. |
---|
51 | 51 | | SECTION 5. This Act takes effect September 1, 2017. |
