66 AN ACT
77 relating to the membership, powers, and duties of the Sunset
88 Advisory Commission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 325, Government Code, is amended by
1111 adding Section 325.0025 to read as follows:
1212 Sec. 325.0025. PURPOSE OF SUNSET ADVISORY COMMISSION. The
1313 primary purpose of the commission is to review state agencies to
1414 evaluate the need for the agency and determine whether the agency or
1515 the agency's functions should be abolished or consolidated in
1616 order to reduce the cost of state government operations.
1717 SECTION 2. Sections 325.003(a) and (j), Government Code,
1818 are amended to read as follows:
1919 (a) The Sunset Advisory Commission consists of five members
2020 of the senate and two [one] public members [member] appointed by the
2121 lieutenant governor, [and] five members of the house of
2222 representatives and two [one] public members [member] appointed by
2323 the speaker of the house, and one public member appointed by the
2424 governor who may only vote on the commission's recommendations that
2525 do not require a statutory change. The lieutenant governor and the
2626 speaker of the house may serve as one of the legislative appointees.
2727 (j) Eight [Seven] members of the commission constitute a
2828 quorum. A final action or recommendation may not be made unless
2929 approved by a record vote of a majority of members appointed by the
3030 lieutenant governor and the speaker of the house. All other actions
3131 by the commission shall be decided by a majority of the members
3232 present and voting.
3333 SECTION 3. Section 325.015(a), Government Code, is amended
3434 to read as follows:
3535 (a) During the regular session immediately before the
3636 abolition of a state agency and its [or an] advisory committees
3737 [committee] that are [is] subject to this chapter, the legislature
3838 by law may continue the agency and any [or] advisory committee of
3939 the agency for a period not to exceed:
4040 (1) eight years for an agency and any advisory
4141 committee of the agency if the agency has 200 or more full-time
4242 equivalent employees; and
4343 (2) 10 [12] years for an agency and any advisory
4444 committee of the agency if the agency has less than 200 full-time
4545 equivalent employees.
4646 SECTION 4. The governor, lieutenant governor, and speaker
4747 of the house of representatives, as soon as possible after the
4848 effective date of this Act, shall appoint public members to serve
4949 initial terms on the Sunset Advisory Commission under Section
5050 325.003, Government Code, as amended by this Act.
5151 SECTION 5. This Act takes effect September 1, 2017.
