| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 49.09, Penal Code, is amended by adding | |
| 11 | 11 | Subsection (i) to read as follows: | |
| 12 | 12 | (i) A conviction may not be used for purposes of enhancement | |
| 13 | 13 | under this section if the conviction was for an offense under | |
| 14 | 14 | Section 49.04, 49.045, 49.05, 49.06, or 49.065 that was committed | |
| 15 | 15 | more than 10 years before the date on which the offense for which | |
| 16 | 16 | the person is being tried was committed. | |
| 17 | 17 | SECTION 2. The change in law made by this Act applies to an | |
| 18 | 18 | offense committed on or after the effective date of this Act and to | |
| 19 | 19 | any criminal action pending on the effective date of this Act for an | |
| 20 | 20 | offense committed before that effective date. A final conviction | |
| 21 | 21 | for an offense punished under Section 49.09, Penal Code, that | |
| 22 | 22 | exists on the effective date of this Act is unaffected by this Act. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2017. |
