55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to convictions considered for purposes of enhancing the
88 punishment for certain intoxication offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 49.09, Penal Code, is amended by adding
1111 Subsection (i) to read as follows:
1212 (i) A conviction may not be used for purposes of enhancement
1313 under this section if the conviction was for an offense under
1414 Section 49.04, 49.045, 49.05, 49.06, or 49.065 that was committed
1515 more than 10 years before the date on which the offense for which
1616 the person is being tried was committed.
1717 SECTION 2. The change in law made by this Act applies to an
1818 offense committed on or after the effective date of this Act and to
1919 any criminal action pending on the effective date of this Act for an
2020 offense committed before that effective date. A final conviction
2121 for an offense punished under Section 49.09, Penal Code, that
2222 exists on the effective date of this Act is unaffected by this Act.
2323 SECTION 3. This Act takes effect September 1, 2017.
