8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 105.004(b), Election Code, is amended to | |
10 | 10 | read as follows: | |
11 | 11 | (b) The secretary of state shall select to participate in | |
12 | 12 | the program any county [a number of counties as determined by the | |
13 | 13 | secretary of state] that: | |
14 | 14 | (1) desires [desire] to participate in the program; | |
15 | 15 | and | |
16 | 16 | (2) is [are] determined by the secretary of state to | |
17 | 17 | have the appropriate technological capabilities. | |
18 | 18 | SECTION 2. Sections 105.004(c), (d), and (e), Election | |
19 | 19 | Code, are repealed. | |
20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
24 | 24 | Act takes effect September 1, 2017. |
