66 AN ACT
77 relating to the indigent status of a person for the purposes of the
88 driver responsibility program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 708.158(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) The department shall waive all surcharges assessed
1313 under this chapter for a person who is indigent. For the purposes
1414 of this section, a person is considered to be indigent if the person
1515 provides the evidence described by Subsection (b) to the court. The
1616 court on its own motion may inquire whether the person would like to
1717 submit evidence to establish the person's indigent status.
1818 SECTION 2. The change in law made by this Act to Section
1919 708.158, Transportation Code, applies only to a trial that begins
2020 on or after the effective date of this Act, regardless of whether
2121 the offense occurred before, on, or after the effective date of this
2222 Act. The state is not required to refund a surcharge collected
2323 before the effective date of this Act.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2017.
