11	4		relating to providing road district powers to the Wood Trace
12	5		Municipal Utility District No. 3 of Montgomery County, Texas;
13	6		providing authority to issue bonds.
14	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	8		SECTION 1. Subtitle F, Title 6, Special District Local Laws
16	9		Code, is amended by adding Chapter 7965 to read as follows:
17	10		CHAPTER 7965. WOOD TRACE MUNICIPAL UTILITY DISTRICT NO. 3 OF
18	11		MONTGOMERY COUNTY, TEXAS
19	12		SUBCHAPTER A. GENERAL PROVISIONS
20	13		Sec. 7965.001. DEFINITION. In this chapter, "district"
21	14		means the Wood Trace Municipal Utility District No. 3 of Montgomery
22	15		County, Texas.
23	16		Sec. 7965.002. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
24	17		The district is created to serve a public purpose and benefit.
25	18		(b) The district is created to accomplish the purposes of:
26	19		(1) a municipal utility district as provided by
27	20		general law and Section 59, Article XVI, Texas Constitution; and
28	21		(2) Section 52, Article III, Texas Constitution, that
29	22		relate to the construction, acquisition, improvement, operation,
30	23		or maintenance of macadamized, graveled, or paved roads, or
31	24		improvements, including storm drainage, in aid of those roads.
32	25		SUBCHAPTER B. POWERS AND DUTIES
33	26		Sec. 7965.101. AUTHORITY FOR ROAD PROJECTS. Under Section
34	27		52, Article III, Texas Constitution, the district may design,
35	28		acquire, construct, finance, issue bonds for, improve, operate,
36	29		maintain, and convey to this state, a county, or a municipality for
37	30		operation and maintenance macadamized, graveled, or paved roads, or
38	31		improvements, including storm drainage, in aid of those roads.
39	32		Sec. 7965.102. ROAD STANDARDS AND REQUIREMENTS. (a) A road
40	33		project must meet all applicable construction standards, zoning and
41	34		subdivision requirements, and regulations of each municipality in
42	35		whose corporate limits or extraterritorial jurisdiction the road
43	36		project is located.
44	37		(b) If a road project is not located in the corporate limits
45	38		or extraterritorial jurisdiction of a municipality, the road
46	39		project must meet all applicable construction standards,
47	40		subdivision requirements, and regulations of each county in which
48	41		the road project is located.
49	42		(c) If the state will maintain and operate the road, the
50	43		Texas Transportation Commission must approve the plans and
51	44		specifications of the road project.
52	45		SUBCHAPTER C. BONDS
53	46		Sec. 7965.201. BONDS FOR ROAD PROJECTS. At the time of
54	47		issuance, the total principal amount of bonds or other obligations
55	48		issued or incurred to finance road projects and payable from ad
56	49		valorem taxes may not exceed one-fourth of the assessed value of the
57	50		real property in the district.
58	51		SECTION 2. (a) The legal notice of the intention to
59	52		introduce this Act, setting forth the general substance of this
60	53		Act, has been published as provided by law, and the notice and a
61	54		copy of this Act have been furnished to all persons, agencies,
62	55		officials, or entities to which they are required to be furnished
63	56		under Section 59, Article XVI, Texas Constitution, and Chapter 313,
64	57		Government Code.
65	58		(b) The governor, one of the required recipients, has
66	59		submitted the notice and Act to the Texas Commission on
67	60		Environmental Quality.
68	61		(c) The Texas Commission on Environmental Quality has filed
69	62		its recommendations relating to this Act with the governor, the
70	63		lieutenant governor, and the speaker of the house of
71	64		representatives within the required time.
72	65		(d) All requirements of the constitution and laws of this
73	66		state and the rules and procedures of the legislature with respect
74	67		to the notice, introduction, and passage of this Act are fulfilled
75	68		and accomplished.
76	69		SECTION 3. This Act takes effect immediately if it receives
77	70		a vote of two-thirds of all the members elected to each house, as
78	71		provided by Section 39, Article III, Texas Constitution. If this
79	72		Act does not receive the vote necessary for immediate effect, this
80	73		Act takes effect September 1, 2017.
