125 relating to the creation of the Montgomery County Municipal Utility
136 District No. 154; granting a limited power of eminent domain;
147 providing authority to issue bonds; providing authority to impose
158 assessments, fees, and taxes.
169 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1710 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1811 Code, is amended by adding Chapter 7974 to read as follows:
1912 CHAPTER 7974. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 154
2013 SUBCHAPTER A. GENERAL PROVISIONS
2114 Sec. 7974.001. DEFINITIONS. In this chapter:
2215 (1) "Board" means the district's board of directors.
2316 (2) "Commission" means the Texas Commission on
2417 Environmental Quality.
2518 (3) "Director" means a board member.
2619 (4) "District" means the Montgomery County Municipal
2720 Utility District No. 154.
2821 Sec. 7974.002. NATURE OF DISTRICT. The district is a
2922 municipal utility district created under Section 59, Article XVI,
3023 Texas Constitution.
3124 Sec. 7974.003. CONFIRMATION AND DIRECTORS' ELECTION
3225 REQUIRED. The temporary directors shall hold an election to
3326 confirm the creation of the district and to elect five permanent
3427 directors as provided by Section 49.102, Water Code.
3528 Sec. 7974.004. CONSENT OF MUNICIPALITY REQUIRED. The
3629 temporary directors may not hold an election under Section 7974.003
3730 until each municipality in whose corporate limits or
3831 extraterritorial jurisdiction the district is located has
3932 consented by ordinance or resolution to the creation of the
4033 district and to the inclusion of land in the district.
4134 Sec. 7974.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4235 The district is created to serve a public purpose and benefit.
4336 (b) The district is created to accomplish the purposes of:
4437 (1) a municipal utility district as provided by
4538 general law and Section 59, Article XVI, Texas Constitution; and
4639 (2) Section 52, Article III, Texas Constitution, that
4740 relate to the construction, acquisition, improvement, operation,
4841 or maintenance of macadamized, graveled, or paved roads, or
4942 improvements, including storm drainage, in aid of those roads.
5043 Sec. 7974.006. INITIAL DISTRICT TERRITORY. (a) The
5144 district is initially composed of the territory described by
5245 Section 2 of the Act enacting this chapter.
5346 (b) The boundaries and field notes contained in Section 2 of
5447 the Act enacting this chapter form a closure. A mistake made in the
5548 field notes or in copying the field notes in the legislative process
5649 does not affect the district's:
5750 (1) organization, existence, or validity;
5851 (2) right to issue any type of bond for the purposes
5952 for which the district is created or to pay the principal of and
6053 interest on a bond;
6154 (3) right to impose a tax; or
6255 (4) legality or operation.
6356 SUBCHAPTER B. BOARD OF DIRECTORS
6457 Sec. 7974.051. GOVERNING BODY; TERMS. (a) The district is
6558 governed by a board of five elected directors.
6659 (b) Except as provided by Section 7974.052, directors serve
6760 staggered four-year terms.
6861 Sec. 7974.052. TEMPORARY DIRECTORS. (a) On or after the
6962 effective date of the Act enacting this chapter, the owner or owners
7063 of a majority of the assessed value of the real property in the
7164 district may submit a petition to the commission requesting that
7265 the commission appoint as temporary directors the five persons
7366 named in the petition. The commission shall appoint as temporary
7467 directors the five persons named in the petition.
7568 (b) Temporary directors serve until the earlier of:
7669 (1) the date permanent directors are elected under
7770 Section 7974.003; or
7871 (2) the fourth anniversary of the effective date of
7972 the Act enacting this chapter.
8073 (c) If permanent directors have not been elected under
8174 Section 7974.003 and the terms of the temporary directors have
8275 expired, successor temporary directors shall be appointed or
8376 reappointed as provided by Subsection (d) to serve terms that
8477 expire on the earlier of:
8578 (1) the date permanent directors are elected under
8679 Section 7974.003; or
8780 (2) the fourth anniversary of the date of the
8881 appointment or reappointment.
8982 (d) If Subsection (c) applies, the owner or owners of a
9083 majority of the assessed value of the real property in the district
9184 may submit a petition to the commission requesting that the
9285 commission appoint as successor temporary directors the five
9386 persons named in the petition. The commission shall appoint as
9487 successor temporary directors the five persons named in the
9588 petition.
9689 SUBCHAPTER C. POWERS AND DUTIES
9790 Sec. 7974.101. GENERAL POWERS AND DUTIES. The district has
9891 the powers and duties necessary to accomplish the purposes for
9992 which the district is created.
10093 Sec. 7974.102. MUNICIPAL UTILITY DISTRICT POWERS AND
10194 DUTIES. The district has the powers and duties provided by the
10295 general law of this state, including Chapters 49 and 54, Water Code,
10396 applicable to municipal utility districts created under Section 59,
10497 Article XVI, Texas Constitution.
10598 Sec. 7974.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10699 52, Article III, Texas Constitution, the district may design,
107100 acquire, construct, finance, issue bonds for, improve, operate,
108101 maintain, and convey to this state, a county, or a municipality for
109102 operation and maintenance macadamized, graveled, or paved roads, or
110103 improvements, including storm drainage, in aid of those roads.
111104 Sec. 7974.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
112105 project must meet all applicable construction standards, zoning and
113106 subdivision requirements, and regulations of each municipality in
114107 whose corporate limits or extraterritorial jurisdiction the road
115108 project is located.
116109 (b) If a road project is not located in the corporate limits
117110 or extraterritorial jurisdiction of a municipality, the road
118111 project must meet all applicable construction standards,
119112 subdivision requirements, and regulations of each county in which
120113 the road project is located.
121114 (c) If the state will maintain and operate the road, the
122115 Texas Transportation Commission must approve the plans and
123116 specifications of the road project.
124117 Sec. 7974.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
125118 OR RESOLUTION. The district shall comply with all applicable
126119 requirements of any ordinance or resolution that is adopted under
127120 Section 54.016 or 54.0165, Water Code, and that consents to the
128121 creation of the district or to the inclusion of land in the
129122 district.
130123 Sec. 7974.106. DIVISION OF DISTRICT. (a) The district may
131124 be divided into two or more new districts only if the district:
132125 (1) has no outstanding bonded debt; and
133126 (2) is not imposing ad valorem taxes.
134127 (b) This chapter applies to any new district created by the
135128 division of the district, and a new district has all the powers and
136129 duties of the district.
137130 (c) Any new district created by the division of the district
138131 may not, at the time the new district is created, contain any land
139132 outside the area described by Section 2 of the Act enacting this
140133 chapter.
141134 (d) The board, on its own motion or on receipt of a petition
142135 signed by the owner or owners of a majority of the assessed value of
143136 the real property in the district, may adopt an order dividing the
144137 district.
145138 (e) The board may adopt an order dividing the district
146139 before or after the date the board holds an election under Section
147140 7974.003 to confirm the district's creation.
148141 (f) An order dividing the district must:
149142 (1) name each new district;
150143 (2) include the metes and bounds description of the
151144 territory of each new district;
152145 (3) appoint temporary directors for each new district;
153146 and
154147 (4) provide for the division of assets and liabilities
155148 between or among the new districts.
156149 (g) On or before the 30th day after the date of adoption of
157150 an order dividing the district, the district shall file the order
158151 with the commission and record the order in the real property
159152 records of each county in which the district is located.
160153 (h) Any new district created by the division of the district
161154 shall hold a confirmation and directors' election as required by
162155 Section 7974.003.
163156 (i) Municipal consent to the creation of the district and to
164157 the inclusion of land in the district granted under Section
165158 7974.004 acts as municipal consent to the creation of any new
166159 district created by the division of the district and to the
167160 inclusion of land in the new district.
168161 (j) Any new district created by the division of the district
169162 must hold an election as required by this chapter to obtain voter
170163 approval before the district may impose a maintenance tax or issue
171164 bonds payable wholly or partly from ad valorem taxes.
172165 (k) If the creation of the new district is confirmed, the
173166 new district shall provide the election date and results to the
174167 commission.
175168 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
176169 Sec. 7974.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
177170 district may issue, without an election, bonds and other
178171 obligations secured by:
179172 (1) revenue other than ad valorem taxes; or
180173 (2) contract payments described by Section 7974.153.
181174 (b) The district must hold an election in the manner
182175 provided by Chapters 49 and 54, Water Code, to obtain voter approval
183176 before the district may impose an ad valorem tax or issue bonds
184177 payable from ad valorem taxes.
185178 (c) The district may not issue bonds payable from ad valorem
186179 taxes to finance a road project unless the issuance is approved by a
187180 vote of a two-thirds majority of the district voters voting at an
188181 election held for that purpose.
189182 Sec. 7974.152. OPERATION AND MAINTENANCE TAX. (a) If
190183 authorized at an election held under Section 7974.151, the district
191184 may impose an operation and maintenance tax on taxable property in
192185 the district in accordance with Section 49.107, Water Code.
193186 (b) The board shall determine the tax rate. The rate may not
194187 exceed the rate approved at the election.
195188 Sec. 7974.153. CONTRACT TAXES. (a) In accordance with
196189 Section 49.108, Water Code, the district may impose a tax other than
197190 an operation and maintenance tax and use the revenue derived from
198191 the tax to make payments under a contract after the provisions of
199192 the contract have been approved by a majority of the district voters
200193 voting at an election held for that purpose.
201194 (b) A contract approved by the district voters may contain a
202195 provision stating that the contract may be modified or amended by
203196 the board without further voter approval.
204197 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
205198 Sec. 7974.201. AUTHORITY TO ISSUE BONDS AND OTHER
206199 OBLIGATIONS. The district may issue bonds or other obligations
207200 payable wholly or partly from ad valorem taxes, impact fees,
208201 revenue, contract payments, grants, or other district money, or any
209202 combination of those sources, to pay for any authorized district
210203 purpose.
211204 Sec. 7974.202. TAXES FOR BONDS. At the time the district
212205 issues bonds payable wholly or partly from ad valorem taxes, the
213206 board shall provide for the annual imposition of a continuing
214207 direct ad valorem tax, without limit as to rate or amount, while all
215208 or part of the bonds are outstanding as required and in the manner
216209 provided by Sections 54.601 and 54.602, Water Code.
217210 Sec. 7974.203. BONDS FOR ROAD PROJECTS. At the time of
218211 issuance, the total principal amount of bonds or other obligations
219212 issued or incurred to finance road projects and payable from ad
220213 valorem taxes may not exceed one-fourth of the assessed value of the
221214 real property in the district.
222215 SECTION 2. The Montgomery County Municipal Utility District
223216 No. 154 initially includes all the territory contained in the
224217 following area:
225218 TRACT 1
226219 A METES AND BOUNDS description of a 279.07 acre tract of land
227220 situated in the Edward Taylor Survey, Abstract Number 554,
228221 Montgomery County, Texas; being all of a called 279.65 acre tract
229222 conveyed to Mitchell Energy Corporation by Surface Deed and
230223 Subsurface Easement dated January 1, 1995 and filed for record
231224 under Clerk's File No. 9509774 of the Montgomery County Official
232225 Public Records of Real Property; said 279.07 acres being more
233226 particularly described as follows with all bearing based on the
234227 Texas Coordinate System of 1983, Central Zone:
235228 BEGINNING at a found 1/2-inch iron rod in the apparent west
236229 right-of-way of Cripple Creek Drive North, for an angle corner in
237230 the north line of Lot 1 of Galleria Oaks Estates as shown on a plat
238231 filed for record in Cabinet B, Sheet 79 of the Montgomery County Map
239232 Records and the southeast corner of said 279.65 acres, same being
240233 the southeast corner of the herein described tract, from which a

802795 SECTION 3. (a) The legal notice of the intention to
803796 introduce this Act, setting forth the general substance of this
804797 Act, has been published as provided by law, and the notice and a

806799 officials, or entities to which they are required to be furnished
807800 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
808801 Government Code.
809802 (b) The governor, one of the required recipients, has
810803 submitted the notice and Act to the Texas Commission on
811804 Environmental Quality.
812805 (c) The Texas Commission on Environmental Quality has filed
813806 its recommendations relating to this Act with the governor, the
814807 lieutenant governor, and the speaker of the house of
815808 representatives within the required time.
816809 (d) All requirements of the constitution and laws of this
817810 state and the rules and procedures of the legislature with respect
818811 to the notice, introduction, and passage of this Act are fulfilled
819812 and accomplished.
820813 SECTION 4. (a) If this Act does not receive a two-thirds
821814 vote of all the members elected to each house, Subchapter C, Chapter
822815 7974, Special District Local Laws Code, as added by Section 1 of
823816 this Act, is amended by adding Section 7974.107 to read as follows:
824817 Sec. 7974.107. NO EMINENT DOMAIN POWER. The district may
825818 not exercise the power of eminent domain.
826819 (b) This section is not intended to be an expression of a
827820 legislative interpretation of the requirements of Section 17(c),
828821 Article I, Texas Constitution.
829822 SECTION 5. This Act takes effect immediately if it receives
830823 a vote of two-thirds of all the members elected to each house, as
831824 provided by Section 39, Article III, Texas Constitution. If this
832825 Act does not receive the vote necessary for immediate effect, this
833826 Act takes effect September 1, 2017.
