| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Article 44.04, Code of Criminal Procedure, is |
|---|
| 15 | 9 | | amended by adding Subsection (i) to read as follows: |
|---|
| 16 | 10 | | (i) Notwithstanding any other law, pending the |
|---|
| 17 | 11 | | determination of a defendant's motion for new trial or the |
|---|
| 18 | 12 | | defendant's appeal from a misdemeanor conviction, the defendant is |
|---|
| 19 | 13 | | entitled to be released after completion of a sentence of |
|---|
| 20 | 14 | | confinement imposed for the conviction. The trial court may require |
|---|
| 21 | 15 | | the defendant to give a personal bond but may not, either instead of |
|---|
| 22 | 16 | | or in addition to the personal bond, require: |
|---|
| 23 | 17 | | (1) any condition of the personal bond; |
|---|
| 24 | 18 | | (2) another type of bail bond; or |
|---|
| 25 | 19 | | (3) a surety or other security. |
|---|
| 26 | 20 | | SECTION 2. This Act takes effect September 1, 2017. |
