104 AN ACT
115 relating to the release of certain defendants pending a motion for
126 new trial or an appeal from a misdemeanor conviction.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Article 44.04, Code of Criminal Procedure, is
159 amended by adding Subsection (i) to read as follows:
1610 (i) Notwithstanding any other law, pending the
1711 determination of a defendant's motion for new trial or the
1812 defendant's appeal from a misdemeanor conviction, the defendant is
1913 entitled to be released after completion of a sentence of
2014 confinement imposed for the conviction. The trial court may require
2115 the defendant to give a personal bond but may not, either instead of
2216 or in addition to the personal bond, require:
2317 (1) any condition of the personal bond;
2418 (2) another type of bail bond; or
2519 (3) a surety or other security.
2620 SECTION 2. This Act takes effect September 1, 2017.
