| 7 | 7 | | relating to the issuance of a notice to appear for certain |
|---|
| 8 | 8 | | misdemeanors. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 543.004(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) An officer shall issue a written notice to appear if: |
|---|
| 13 | 13 | | (1) the offense charged is: |
|---|
| 14 | 14 | | (A) speeding; |
|---|
| 15 | 15 | | (B) driving with an expired driver's license |
|---|
| 16 | 16 | | under Section 521.025; |
|---|
| 17 | 17 | | (C) failure to obey a traffic-control signal |
|---|
| 18 | 18 | | under Section 544.007; |
|---|
| 19 | 19 | | (D) failure to stop at a stop sign under Section |
|---|
| 20 | 20 | | 544.010; |
|---|
| 21 | 21 | | (E) failure to signal a lane change under Section |
|---|
| 22 | 22 | | 545.104; |
|---|
| 23 | 23 | | (F) operation of a motor vehicle in violation of |
|---|
| 24 | 24 | | the motor vehicle liability insurance requirement under Section |
|---|
| 25 | 25 | | 601.191; or |
|---|
| 26 | 26 | | (G) a violation of the open container law, |
|---|
| 27 | 27 | | Section 49.031 [49.03], Penal Code; and |
|---|
| 28 | 28 | | (2) the person makes a written promise to appear in |
|---|
| 29 | 29 | | court as provided by Section 543.005. |
|---|
| 30 | 30 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to an offense committed on or after the effective date of this Act. |
|---|
| 32 | 32 | | An offense committed before the effective date of this Act is |
|---|
| 33 | 33 | | governed by the law in effect on the date the offense was committed, |
|---|
| 34 | 34 | | and the former law is continued in effect for that purpose. For |
|---|
| 35 | 35 | | purposes of this section, an offense was committed before the |
|---|
| 36 | 36 | | effective date of this Act if any element of the offense occurred |
|---|
| 37 | 37 | | before that date. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2017. |
