55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the issuance of a notice to appear for certain
88 misdemeanors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 543.004(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) An officer shall issue a written notice to appear if:
1313 (1) the offense charged is:
1414 (A) speeding;
1515 (B) driving with an expired driver's license
1616 under Section 521.025;
1717 (C) failure to obey a traffic-control signal
1818 under Section 544.007;
1919 (D) failure to stop at a stop sign under Section
2020 544.010;
2121 (E) failure to signal a lane change under Section
2222 545.104;
2323 (F) operation of a motor vehicle in violation of
2424 the motor vehicle liability insurance requirement under Section
2525 601.191; or
2626 (G) a violation of the open container law,
2727 Section 49.031 [49.03], Penal Code; and
2828 (2) the person makes a written promise to appear in
2929 court as provided by Section 543.005.
3030 SECTION 2. The change in law made by this Act applies only
3131 to an offense committed on or after the effective date of this Act.
3232 An offense committed before the effective date of this Act is
3333 governed by the law in effect on the date the offense was committed,
3434 and the former law is continued in effect for that purpose. For
3535 purposes of this section, an offense was committed before the
3636 effective date of this Act if any element of the offense occurred
3737 before that date.
3838 SECTION 3. This Act takes effect September 1, 2017.
