14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 9 | | SECTION 1. Subtitle F, Title 6, Special District Local Laws |
---|
16 | 10 | | Code, is amended by adding Chapter 7967 to read as follows: |

17 | 11 | | CHAPTER 7967. MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT |

19 | 13 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
20 | 14 | | Sec. 7967.001. DEFINITION. In this chapter, "district" |
---|
21 | 15 | | means the Montgomery County Municipal Utility District No. 131. |
---|
22 | 16 | | Sec. 7967.002. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a) |
---|
23 | 17 | | The district is created to serve a public purpose and benefit. |
---|
24 | 18 | | (b) The district is created to accomplish the purposes of: |
---|
25 | 19 | | (1) a municipal utility district as provided by |
---|
26 | 20 | | general law and Section 59, Article XVI, Texas Constitution; and |
---|
27 | 21 | | (2) Section 52, Article III, Texas Constitution, that |
---|
28 | 22 | | relate to the construction, acquisition, improvement, operation, |
---|
29 | 23 | | or maintenance of macadamized, graveled, or paved roads, or |
---|
30 | 24 | | improvements, including storm drainage, in aid of those roads. |

31 | 25 | | SUBCHAPTER B. POWERS AND DUTIES |
---|
32 | 26 | | Sec. 7967.101. AUTHORITY FOR ROAD PROJECTS. Under Section |
---|
33 | 27 | | 52, Article III, Texas Constitution, the district may design, |
---|
34 | 28 | | acquire, construct, finance, issue bonds for, improve, operate, |
---|
35 | 29 | | maintain, and convey to this state, a county, or a municipality for |
---|
36 | 30 | | operation and maintenance macadamized, graveled, or paved roads, or |
---|
37 | 31 | | improvements, including storm drainage, in aid of those roads. |
---|
38 | 32 | | Sec. 7967.102. ROAD STANDARDS AND REQUIREMENTS. (a) A road |
---|
39 | 33 | | project must meet all applicable construction standards, zoning and |
---|
40 | 34 | | subdivision requirements, and regulations of each municipality in |
---|
41 | 35 | | whose corporate limits or extraterritorial jurisdiction the road |
---|
42 | 36 | | project is located. |
---|
43 | 37 | | (b) If a road project is not located in the corporate limits |
---|
44 | 38 | | or extraterritorial jurisdiction of a municipality, the road |
---|
45 | 39 | | project must meet all applicable construction standards, |
---|
46 | 40 | | subdivision requirements, and regulations of each county in which |
---|
47 | 41 | | the road project is located. |
---|
48 | 42 | | (c) If the state will maintain and operate the road, the |
---|
49 | 43 | | Texas Transportation Commission must approve the plans and |
---|
50 | 44 | | specifications of the road project. |
---|
51 | 45 | | SUBCHAPTER C. BONDS |
---|
52 | 46 | | Sec. 7967.201. BONDS FOR ROAD PROJECTS. At the time of |
---|
53 | 47 | | issuance, the total principal amount of bonds or other obligations |
---|
54 | 48 | | issued or incurred to finance road projects and payable from ad |
---|
55 | 49 | | valorem taxes may not exceed one-fourth of the assessed value of the |
---|
56 | 50 | | real property in the district. |
---|
57 | 51 | | SECTION 2. (a) The legal notice of the intention to |
---|
58 | 52 | | introduce this Act, setting forth the general substance of this |
---|
59 | 53 | | Act, has been published as provided by law, and the notice and a |
---|
60 | 54 | | copy of this Act have been furnished to all persons, agencies, |
---|
61 | 55 | | officials, or entities to which they are required to be furnished |
---|
62 | 56 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
63 | 57 | | Government Code. |
---|
64 | 58 | | (b) The governor, one of the required recipients, has |
---|
65 | 59 | | submitted the notice and Act to the Texas Commission on |
---|
66 | 60 | | Environmental Quality. |
---|
67 | 61 | | (c) The Texas Commission on Environmental Quality has filed |
---|
68 | 62 | | its recommendations relating to this Act with the governor, the |
---|
69 | 63 | | lieutenant governor, and the speaker of the house of |
---|
70 | 64 | | representatives within the required time. |
---|
71 | 65 | | (d) All requirements of the constitution and laws of this |
---|
72 | 66 | | state and the rules and procedures of the legislature with respect |
---|
73 | 67 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
74 | 68 | | and accomplished. |
---|
75 | 69 | | SECTION 3. This Act takes effect immediately if it receives |
---|
76 | 70 | | a vote of two-thirds of all the members elected to each house, as |
---|
77 | 71 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
78 | 72 | | Act does not receive the vote necessary for immediate effect, this |
---|
79 | 73 | | Act takes effect September 1, 2017. |
