1010 relating to fantasy sports contests.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 13, Occupations Code, is
1313 amended by adding Chapter 2053 to read as follows:
1414 CHAPTER 2053. FANTASY SPORTS CONTESTS
1515 Sec. 2053.001. DEFINITIONS. In this chapter:
1616 (1) "Fantasy sports contest" means a competition in
1717 which:
1818 (A) a participant pays money or other
1919 consideration for the opportunity to assemble a fictional team
2020 composed of professional or amateur sports athletes selected by the
2121 participant to compete against other fictional teams assembled by
2222 other competition participants;
2323 (B) the outcome of the competition reflects the
2424 relative knowledge and skill of the participants and is based on the
2525 actual statistical performance of the selected athletes in sports
2626 competitions, or in a season or series of sports competitions;
2727 (C) a prize is awarded to the competition winner;
2828 (D) the outcome of the competition or the
2929 redemption of the winnings is not displayed or represented in a
3030 manner that mimics a slot machine or other form of casino gaming,
3131 including a banked card game, poker, craps, roulette, keno, lotto,
3232 and bingo; and
3333 (E) the competition is not presented using any
3434 depiction of a casino gaming graphic, theme, or title, including
3535 any depiction of a slot machine-style symbol, a banked card game,
3636 poker, craps, roulette, keno, lotto, and bingo.
3737 (2) "Fantasy sports operator" means a person,
3838 including an entity, or a division of an entity, that offers fantasy
3939 sports contests to the public.
4040 Sec. 2053.002. LEGISLATIVE FINDINGS. (a) The legislature
4141 finds that a participant in a fantasy sports contest is an actual
4242 contestant in a bona fide contest for the determination of the skill
4343 of the participant in assembling a fictional team of sports
4444 athletes.
4545 (b) A person who pays an entrance fee to compete in a fantasy
4646 sports contest is not placing a bet for purposes of the application
4747 of an offense under Chapter 47, Penal Code.
4848 Sec. 2053.003. PARTICIPATION IN FANTASY SPORTS CONTEST. A
4949 person may pay an entrance fee to participate in a fantasy sports
5050 contest.
5151 Sec. 2053.004. OPERATION OF FANTASY SPORTS CONTEST. (a) A
5252 person may offer fantasy sports contests as a fantasy sports
5353 operator in this state in accordance with this chapter and any
5454 applicable federal law and may participate in the earnings of a
5555 business that offers fantasy sports contests.
5656 (b) A fantasy sports operator may not:
5757 (1) award a prize based:
5858 (A) on the score, the point spread, or any
5959 performance of a single professional or amateur sports team or any
6060 combination of professional or amateur sports teams;
6161 (B) solely on any single performance of an
6262 individual athlete in a single professional or amateur sports
6363 competition or other event; or
6464 (C) on live pari-mutuel racing under the Texas
6565 Racing Act (Article 179e, Vernon's Texas Civil Statutes);
6666 (2) offer a fantasy sports contest to the public
6767 without disclosing before the contest all prizes or awards offered
6868 to winning participants of the contest; or
6969 (3) offer a fantasy sports contest based on the
7070 performance of athletes in a youth, high school, or collegiate
7171 sports competition or athletic event.
7272 Sec. 2053.005. CONSUMER PROTECTION. A fantasy sports
7373 operator shall implement commercially reasonable procedures for
7474 fantasy sports contests that:
7575 (1) prevent an employee of the operator, and any
7676 relative living in the same household as the employee, from
7777 competing in a fantasy sports contest in which a cash prize is
7878 awarded;
7979 (2) prohibit the operator from being a participant in
8080 a fantasy sports contest that the operator offers;
8181 (3) prevent an employee or agent of the operator from
8282 sharing with third parties confidential information that could
8383 affect fantasy sports contest play until the information has been
8484 made publicly available;
8585 (4) verify that fantasy sports contest participants
8686 are 18 years of age or older;
8787 (5) restrict an individual who is a player, a game
8888 official, or another participant in a professional or amateur
8989 sports competition from participating in a fantasy sports contest
9090 that is determined, wholly or partly, on the performance of that
9191 individual, the individual's professional or amateur team, or the
9292 accumulated statistical results of the sport or competition in
9393 which the individual is a player, game official, or other
9494 participant; and
9595 (6) prevent the commingling of fantasy contest player
9696 funds with operational funds unless the operator maintains a
9797 reserve that:
9898 (A) exceeds the amount of contest player funds on
9999 deposit with the operator;
100100 (B) is not used by the operator for operational
101101 activities; and
102102 (C) is in the form of cash, cash equivalents,
103103 payment processor reserves, payment processor receivables,
104104 irrevocable letters of credit, bonds, or any combination of those
105105 items.
106106 Sec. 2053.006. INJUNCTIVE RELIEF. (a) The attorney
107107 general may institute an action for injunctive relief to restrain a
108108 violation by a person who appears to be in violation of or
109109 threatening to violate this chapter.
110110 (b) An action filed under this section by the attorney
111111 general must be filed in a district court in Travis County or the
112112 county in which the violation occurred.
113113 (c) The attorney general may recover reasonable expenses
114114 incurred in obtaining injunctive relief under this section,
115115 including court costs, reasonable attorney's fees, investigative
116116 costs, witness fees, and deposition expenses.
117117 (d) In an injunction issued under this section, a court may
118118 include reasonable requirements to prevent further violations of
119119 this chapter.
120120 SECTION 2. Section 47.02(c), Penal Code, is amended to read
121121 as follows:
122122 (c) It is a defense to prosecution under this section that
123123 the actor reasonably believed that the conduct:
124124 (1) was permitted under Chapter 2001, Occupations
125125 Code;
126126 (2) was permitted under Chapter 2002, Occupations
127127 Code;
128128 (3) was permitted under Chapter 2004, Occupations
129129 Code;
130130 (4) was permitted under Chapter 2053, Occupations
131131 Code;
132132 (5) consisted entirely of participation in the state
133133 lottery authorized by the State Lottery Act (Chapter 466,
134134 Government Code);
135135 (6) [(5)] was permitted under the Texas Racing Act
136136 (Article 179e, Vernon's Texas Civil Statutes); or
137137 (7) [(6)] consisted entirely of participation in a
138138 drawing for the opportunity to participate in a hunting, fishing,
139139 or other recreational event conducted by the Parks and Wildlife
140140 Department.
141141 SECTION 3. Section 47.09(a), Penal Code, is amended to read
142142 as follows:
143143 (a) It is a defense to prosecution under this chapter that
144144 the conduct:
145145 (1) was authorized under:
146146 (A) Chapter 2001, Occupations Code;
147147 (B) Chapter 2002, Occupations Code;
148148 (C) Chapter 2004, Occupations Code; [or]
149149 (D) Chapter 2053, Occupations Code; or
150150 (E) the Texas Racing Act (Article 179e, Vernon's
151151 Texas Civil Statutes);
152152 (2) consisted entirely of participation in the state
153153 lottery authorized by Chapter 466, Government Code; or
154154 (3) was a necessary incident to the operation of the
155155 state lottery and was directly or indirectly authorized by:
156156 (A) Chapter 466, Government Code;
157157 (B) the lottery division of the Texas Lottery
158158 Commission;
159159 (C) the Texas Lottery Commission; or
160160 (D) the director of the lottery division of the
161161 Texas Lottery Commission.
162162 SECTION 4. This Act takes effect immediately if it receives
163163 a vote of two-thirds of all the members elected to each house, as
164164 provided by Section 39, Article III, Texas Constitution. If this
165165 Act does not receive the vote necessary for immediate effect, this
166166 Act takes effect September 1, 2017.
