55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the management and operation of certain municipally
88 owned electric utilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 552.122, Local Government Code, is
1111 amended by adding Subsection (c) to read as follows:
1212 (c) Notwithstanding any other law, including a municipal
1313 ordinance or provision of a municipal charter, a municipality with
1414 a population of less than 850,000 that is served by a municipally
1515 owned electric utility system with 400,000 or more customers may
1616 transfer management and control of the municipality's electric
1717 utility system to a board of trustees appointed by the
1818 municipality's governing body.
1919 SECTION 2. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2017.
