9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 552.122, Local Government Code, is | |
11 | 11 | amended by adding Subsection (c) to read as follows: | |
12 | 12 | (c) Notwithstanding any other law, including a municipal | |
13 | 13 | ordinance or provision of a municipal charter, a municipality with | |
14 | 14 | a population of less than 850,000 that is served by a municipally | |
15 | 15 | owned electric utility system with 400,000 or more customers may | |
16 | 16 | transfer management and control of the municipality's electric | |
17 | 17 | utility system to a board of trustees appointed by the | |
18 | 18 | municipality's governing body. | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2017. |
