66 AN ACT
77 relating to the extent of a defendant's criminal responsibility for
88 the conduct of a coconspirator in certain felony cases.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1, Article 37.071, Code of Criminal
1111 Procedure, is amended to read as follows:
1212 Sec. 1. (a) If a defendant is found guilty in a capital
1313 felony case in which the state does not seek the death penalty, the
1414 judge shall sentence the defendant to life imprisonment or to life
1515 imprisonment without parole as required by Section 12.31, Penal
1616 Code.
1717 (b) A defendant who is found guilty in a capital felony case
1818 only as a party under Section 7.02(b), Penal Code, may not be
1919 sentenced to death, and the state may not seek the death penalty in
2020 any case in which the defendant's liability is based solely on that
2121 subsection.
2222 SECTION 2. Section 2, Article 37.0711, Code of Criminal
2323 Procedure, is amended to read as follows:
2424 Sec. 2. (a) If a defendant is found guilty in a case in
2525 which the state does not seek the death penalty, the judge shall
2626 sentence the defendant to life imprisonment.
2727 (b) A defendant who is found guilty in a capital felony case
2828 only as a party under Section 7.02(b), Penal Code, may not be
2929 sentenced to death, and the state may not seek the death penalty in
3030 any case in which the defendant's liability is based solely on that
3131 subsection.
3232 SECTION 3. The change in law made by this Act applies to a
3333 criminal proceeding that commences on or after the effective date
3434 of this Act. A criminal proceeding that commences before the
3535 effective date of this Act is governed by the law in effect when the
3636 proceeding commenced, and the former law is continued in effect for
3737 that purpose.
3838 SECTION 4. This Act takes effect September 1, 2017.
