66 AN ACT
77 relating to required workers' compensation insurance coverage for
88 building and construction contractors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 406.096, Labor Code, is
1111 amended to read as follows:
1212 Sec. 406.096. REQUIRED COVERAGE FOR [CERTAIN] BUILDING OR
1313 CONSTRUCTION CONTRACTORS.
1414 SECTION 2. Section 406.096, Labor Code, is amended by
1515 amending Subsections (a), (b), and (c) and adding Subsection (a-1)
1616 to read as follows:
1717 (a) A contractor shall provide workers' compensation
1818 insurance coverage for each employee of the contractor. A
1919 subcontractor shall provide workers' compensation insurance
2020 coverage for each employee of the subcontractor.
2121 (a-1) A governmental entity that enters into a building or
2222 construction contract shall require the contractor to:
2323 (1) certify in writing that the contractor provides
2424 workers' compensation insurance coverage for each employee of the
2525 contractor employed on the public project; and
2626 (2) if the contractor uses a subcontractor on the
2727 public project, provide a written certification, submitted by each
2828 subcontractor, that the subcontractor provides workers'
2929 compensation insurance coverage for each employee of the
3030 subcontractor employed on the public project.
3131 (b) Each subcontractor on a [the] public project shall
3232 provide the [such a] certificate described by Subsection (a-1)(2)
3333 [relating to coverage of the subcontractor's employees] to the
3434 general contractor, who shall provide the subcontractor's
3535 certificate to the governmental entity.
3636 (c) A contractor or subcontractor may provide [who has a
3737 contract that requires] workers' compensation insurance coverage
3838 [may provide the coverage] through a group plan or other method. If
3939 the contractor enters into a contract with a governmental entity
4040 for a public project, the coverage provided by the contractor and,
4141 if applicable, by each subcontractor must be satisfactory to the
4242 governing body of the governmental entity.
4343 SECTION 3. The change in law made by this Act applies only
4444 to a contract for building or construction that is entered into on
4545 or after the effective date of this Act. A contract entered into
4646 before the effective date of this Act is governed by the law in
4747 effect on the date the contract was entered into, and the former law
4848 is continued in effect for that purpose.
4949 SECTION 4. This Act takes effect September 1, 2017.
