66 AN ACT
77 relating to prohibiting the use of credit scoring in certain lines
88 of personal insurance.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 559.001(2), (4), and (7), Insurance
1111 Code, are amended to read as follows:
1212 (2) "Agent" means a person licensed or required to be
1313 licensed as a [general] property and casualty insurance agent [or a
1414 personal lines property and casualty agent] under Subchapter B, C,
1515 D, or E, Chapter 4051.
1616 (4) "Consumer" means an individual whose credit
1717 information has been reported to or is in the possession of a
1818 consumer reporting agency or an insurer [is used or whose credit
1919 score is computed in the underwriting or rating of a personal
2020 insurance policy]. The term includes an applicant for insurance
2121 coverage.
2222 (7) "Credit report" means any written, oral, or other
2323 communication of information by a consumer reporting agency that[:
2424 [(A)] bears on a consumer's creditworthiness,
2525 credit standing, or credit capacity[; and
2626 [(B) is used or expected to be used or collected
2727 in whole or in part to serve as a factor to determine personal
2828 insurance premiums, eligibility for coverage, or tier placement].
2929 SECTION 2. Section 559.002, Insurance Code, is amended to
3030 read as follows:
3131 Sec. 559.002. APPLICABILITY OF CHAPTER. This chapter
3232 applies to each [an] insurer that writes personal insurance
3333 coverage [and uses credit information or credit reports for the
3434 underwriting or rating of that coverage].
3535 SECTION 3. Section 559.052, Insurance Code, is amended to
3636 read as follows:
3737 Sec. 559.052. [PROHIBITED] USE OF CREDIT INFORMATION
3838 PROHIBITED. (a) An insurer may not:
3939 (1) use an underwriting guideline [a credit score]
4040 that is based wholly or partly on the credit information, credit
4141 report, or credit score of an applicant for insurance coverage or
4242 any person other than the applicant who would be insured under a
4343 policy of personal insurance [computed using factors that
4444 constitute unfair discrimination];
4545 (2) refuse to underwrite or [deny,] cancel[,] or
4646 nonrenew a policy of personal insurance based wholly or partly
4747 [solely] on the [basis of] credit information, credit report, or
4848 credit score of an applicant for insurance coverage or any person
4949 other than the applicant who would be insured under the policy
5050 [without considering any other applicable underwriting factor
5151 independent of credit information]; [or]
5252 (3) take an action that results in an adverse effect
5353 against a consumer because the consumer does not have a credit card
5454 account;
5555 (4) charge an applicant for insurance coverage a
5656 higher premium than otherwise would be charged based wholly or
5757 partly on the credit information, credit report, or credit score of
5858 the applicant or any person other than the applicant who would be
5959 insured under a policy of personal insurance;
6060 (5) rate a risk based wholly or partly on the credit
6161 information, credit report, or credit score of an applicant for
6262 insurance coverage or any person other than the applicant who would
6363 be insured under a policy of personal insurance, including:
6464 (A) providing or removing a discount;
6565 (B) assigning the applicant for insurance
6666 coverage to a rating tier; or
6767 (C) placing an applicant for insurance coverage
6868 with an affiliated company; or
6969 (6) require a particular payment plan based wholly or
7070 partly on the credit information, credit report, or credit score of
7171 the applicant for insurance coverage or any person other than the
7272 applicant who would be insured under a policy of personal insurance
7373 [without considering any other applicable factor independent of
7474 credit information].
7575 (b) An insurer may not consider an absence of credit
7676 information or an inability to determine credit information for an
7777 applicant for insurance coverage or for an insured as a factor in
7878 underwriting or rating an insurance policy [unless the insurer:
7979 [(1) has statistical, actuarial, or reasonable
8080 underwriting information that:
8181 [(A) is reasonably related to actual or
8282 anticipated loss experience; and
8383 [(B) shows that the absence of credit information
8484 could result in actual or anticipated loss differences;
8585 [(2) treats the consumer as if the applicant for
8686 insurance coverage or insured had neutral credit information, as
8787 defined by the insurer; or
8888 [(3) excludes the use of credit information as a
8989 factor in underwriting and uses only other underwriting criteria].
9090 SECTION 4. Section 559.055, Insurance Code, is amended by
9191 adding Subsection (c) to read as follows:
9292 (c) This section expires September 1, 2018.
9393 SECTION 5. The following laws are repealed:
9494 (1) Section 559.004(b), Insurance Code;
9595 (2) Sections 559.003, 559.051, 559.053, 559.054, and
9696 559.056, Insurance Code; and
9797 (3) Subchapters C and D, Chapter 559, Insurance Code.
9898 SECTION 6. (a) The changes in law made by this Act apply
9999 only to a personal insurance policy:
100100 (1) that is delivered, issued for delivery, or renewed
101101 on or after January 1, 2018;
102102 (2) the application for which is submitted on or after
103103 January 1, 2018; or
104104 (3) that is subject to determination of refusal to
105105 underwrite, cancellation, or nonrenewal on or after January 1,
106106 2018.
107107 (b) A personal insurance policy delivered, issued for
108108 delivery, or renewed before January 1, 2018, or the application for
109109 which is submitted before January 1, 2018, is governed by the law as
110110 it existed immediately before January 1, 2018, and that law is
111111 continued in effect for that purpose.
112112 SECTION 7. This Act takes effect September 1, 2017.
