10 | 10 | | the ad valorem tax rate of a school district. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 26.08(b), Tax Code, is amended to read as |
---|
13 | 13 | | follows: |
---|
14 | 14 | | (b) The governing body shall order that the election be held |
---|
15 | 15 | | in the school district on the first uniform election date |
---|
16 | 16 | | prescribed by [a date not less than 30 or more than 90 days after the |
---|
17 | 17 | | day on which it adopted the tax rate.] Section 41.001, Election |
---|
18 | 18 | | Code, that allows sufficient time to comply with other requirements |
---|
19 | 19 | | of law [does not apply to the election unless a date specified by |
---|
20 | 20 | | that section falls within the time permitted by this section]. At |
---|
21 | 21 | | the election, the ballots shall be prepared to permit voting for or |
---|
22 | 22 | | against the proposition: "Approving the ad valorem tax rate of |
---|
23 | 23 | | $_____ per $100 valuation in (name of school district) for the |
---|
24 | 24 | | current year, a rate that is $_____ higher per $100 valuation than |
---|
25 | 25 | | the school district rollback tax rate, for the purpose of |
---|
26 | 26 | | (description of purpose of increase)." The ballot proposition must |
---|
27 | 27 | | include the adopted tax rate and the difference between that rate |
---|
28 | 28 | | and the rollback tax rate in the appropriate places. |

29 | 29 | | SECTION 2. Section 3.005(a), Election Code, is amended to |
---|
30 | 30 | | read as follows: |
---|
31 | 31 | | (a) Except as provided by Subsection [Subsections] (c) [and |
---|
32 | 32 | | (d)], an election ordered by an authority of a political |
---|
33 | 33 | | subdivision shall be ordered not later than the 62nd day before |
---|
34 | 34 | | election day. |
---|
35 | 35 | | SECTION 3. Section 3.005(d), Election Code, is repealed. |
---|
36 | 36 | | SECTION 4. (a) The change in law made by this Act applies to |
---|
37 | 37 | | the ad valorem tax rate of a school district beginning with the 2017 |
---|
38 | 38 | | tax year, except as provided by Subsection (b) of this section. |
---|
39 | 39 | | (b) If the governing body of a school district adopted an ad |
---|
40 | 40 | | valorem tax rate for the school district for the 2017 tax year |
---|
41 | 41 | | before the effective date of this Act, the change in law made by |
---|
42 | 42 | | this Act applies to the ad valorem tax rate of that school district |
---|
43 | 43 | | beginning with the 2018 tax year, and the law in effect when the tax |
---|
44 | 44 | | rate was adopted applies to the 2017 tax year with respect to that |
---|
45 | 45 | | school district. |
---|
46 | 46 | | SECTION 5. This Act takes effect immediately if it receives |
---|
47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
---|
48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
---|
50 | 50 | | Act takes effect on the 91st day after the last day of the |
---|
51 | 51 | | legislative session. |
