| 7 | 7 | | relating to the appropriation of money from the economic |

| 8 | 8 | | stabilization fund for maintenance and repairs at institutions of |
|---|
| 9 | 9 | | higher education. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. (a) The legislature finds, in part based on |
|---|
| 12 | 12 | | information concerning deferred maintenance included in the annual |
|---|
| 13 | 13 | | reports required by Section 61.05821, Education Code, that there is |
|---|
| 14 | 14 | | a demonstrated need to fund previously deferred maintenance and |
|---|
| 15 | 15 | | repairs of buildings and facilities at general academic and |
|---|
| 16 | 16 | | health-related institutions of higher education. |
|---|
| 17 | 17 | | (b) In addition to other amounts appropriated to the Texas |
|---|
| 18 | 18 | | Higher Education Coordinating Board for the state fiscal biennium |
|---|
| 19 | 19 | | ending August 31, 2019, $500 million is appropriated out of the |
|---|
| 20 | 20 | | economic stabilization fund to the Texas Higher Education |
|---|
| 21 | 21 | | Coordinating Board for that state fiscal biennium for purposes of: |
|---|
| 22 | 22 | | (1) allocating, in the manner provided by Subsection |
|---|
| 23 | 23 | | (c) of this section, a portion of the money to each institution of |
|---|
| 24 | 24 | | higher education that was included in the board's 2012 report on |
|---|
| 25 | 25 | | accumulated deferred maintenance needs at institutions of higher |
|---|
| 26 | 26 | | education as having deferred necessary maintenance of the |
|---|
| 27 | 27 | | institution's buildings and facilities; and |
|---|
| 28 | 28 | | (2) distributing the allocated amounts to those |
|---|
| 29 | 29 | | institutions of higher education to be used during that state |
|---|
| 30 | 30 | | fiscal biennium for previously deferred maintenance and repairs, |
|---|
| 31 | 31 | | infrastructure support, and rehabilitation of buildings and |
|---|
| 32 | 32 | | facilities at those institutions. |
|---|
| 33 | 33 | | (c) The Texas Higher Education Coordinating Board shall |
|---|
| 34 | 34 | | allocate money to each institution of higher education described by |
|---|
| 35 | 35 | | Subsection (b)(1) of this section in the proportion that the cost of |
|---|
| 36 | 36 | | the deferred maintenance at that institution as specified in the |
|---|
| 37 | 37 | | 2012 report described by that subdivision bears to the total cost of |
|---|
| 38 | 38 | | the deferred maintenance at all institutions of higher education as |
|---|
| 39 | 39 | | specified in that report. |
|---|
| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2017, but only |
|---|
| 41 | 41 | | if the Act receives a vote of two-thirds of the members present in |
|---|
| 42 | 42 | | each house of the legislature, as provided by Section 49-g(m), |
|---|
| 43 | 43 | | Article III, Texas Constitution. |
